Hi!

I'm applying for PR using Provincial Nominee.
I have a Common-law partner who is a Canadian citizen, however, I'm not getting sponsership from him since I've already got approval from AINP. (And I didn't wanna go through all the process to "prove the relationship")
Recently we got engaged and we're getting married next year.

So now, my question is, do I still need to get the signature from commissioner of oath for Common-law form?
The check list says that I need to submit IMM5409E if I have a common-law partner - which I do.
But he's not sponsering and we're having an officiant to marry us next year, so it seems a bit odd to go see a commissioner of oath...

Is there anyone who apply for PR while being engaged?
Did you still get the approval (or signature, I guess) from commissioner of oath even though you're getting married?

"Engaged" is not a legal term for immigration purposes. You are either common-law, or you're married. So until you're officially married you are common-law and need to proceed as such.

Since your common-law partner is a Canadian citizen and is not included in your application as a dependent, i'm not sure if the declaration of common-law form is really necessary. However I'm not sure on this so better to get some responses from others that have gone through immigration outside family class with a Canadian common-law partner. Since the checklist does ask for it, to be absolutely safe I would just include it if it's not too much trouble.
