I'm Just wondering If both my spouse and I need to fill this out, He is the one being sponsored.

When we do fill It out do we just fill out children. or do we fill in all the empty spaces, I.E: brother, sister, father, mother. Etc, For both of us?

Only the person being sponsored fills it out.

As clearly shown in the guide, ALL family members must be listed.

Many applicants, including myself, have struggled to make sense of the guide to completing this form, which I still find very unclear. It seems to suggest that the sponsor, if he or she is the spouse or CL partner of the applicant, also has to complete a form. That may not be necessary. You may find some further help in this thread:http://www.canadavisa.com/canada-immigration-discussion-board/additional-family-information-imm-5406-question-t123955.0.html When I applied I dealt with the ambiguity by sending two forms, one completed by myself and the other by my CL partner and sponsor, a Canadian citizen. My application ended successfully; so there is something to be said for ignoring the commonly expressed opinion on this forum that only the principal applicant needs to complete a form. If you follow my precedent, the principal applicant's form will contain details of you as his spouse and of his parents and his brothers and sisters, and your separate form will contain details of him as your spouse, your parents and your siblings. I feel sure that there are many members of this forum who disagree with me, but there surely can be no harm in sending two separate forms, one by the principal applicant and another by the sponsoring spouse!

Our Document Checklist was pretty clear. Item #11 reads:

"Original of completed Additional Family Information (IMM 5406), for the SPONSORED PERSON and each family member 18 years of age or over, signed by the person concerned."

The issue with this form, and others, is that they are not specific to just spousal sponsorship. They are used for every immigration application, so CIC has made them, and the accompanying sections in the guides, fairly generic. Immigration streams like parent/grandparent sponsorship, CEC, FSW and PNP often have both the principal applicant and their spouse immigrating; as such, both must fill out those forms.

The distinction for spousal sponsorship is made in the guide, under "Who should be included in this application?"

http://www.cic.gc.ca/english/information/applications/guides/3999Etoc.asp#family

If you are being sponsored as a member of the family class, your spouse or common-law partner (except where your spouse or common-law partner is the sponsor) must be included in your application as a family member.

That means that for the purposes of spousal sponsorship, the sponsor is not included in the app as a family member and therefore doesn't need to fill out those forms. CIC could definitely explain it much better than they do but as we all know, CIC is not known for clarity...

For the outland application package, the forms are divided into "sponsor" and "applicant or immigrant". IMM 5406 is not listed under the sponsor's forms, so this was how I figured it out.

Thank you Canuck_in_UK for clarifyingthe issue. I hope someone at CIC reads what you say and revises the instructions for filling out IMM 5406 in the light of it.
