IMM3903E Instruction Guide 8 (Family Class sponsor spouse from outside Canada)

Hello,

Please see my following question about sponsor my wife from China immigrant to Canada. The instruction form IMM3903E

8.Declaration from Non-Accompanying Parent/Guardian for Minors Immigrating to Canada
(IMM 5604) – This form is to be completed by:
• non-accompanying parents/guardians,
• former spouses, or
• former common-law partners
who consent to the removal of their child from their country of residence and for the child to
immigrate to Canada with the other parent.


My question is: my wife has a 5 year old daughter from prior relationship, the daughter's father actually never appear since the birth of the Child, means there is no contact at all since, and the person is disappear, even though the child is with the mother all the time and the mother has full custody, BUT there never had any legal documentation such as court order or something state that the mother has the full custody. (My wife is from small country side place, and the paper work of such as not that formal). So in this situation, how can we find the daughter's father to sign or give his identification? And how can my wife now apply the full custody legal paper?

You'll have to track him down somehow, with a private investigator or however you see fit best. OR, obtain FULL legal custody from whichever court has jurisdiction.

One additional information/question on this thread.

This 5 year old daughter of my wife's prior relationship will NOT accompany principal applicant to Canada. so, Question is: this #8 requirement maybe dont even needed to be filled?
