I'm in Thailand with my wife, and on her application we've stated that I am currently here with her, and the form is signed and dated. Now I'm looking at these forms.
Imm 5540 #6 Are you currently employed?
Well.... I will be in a few weeks when I return.

Imm 5540 #11 Are you currently living in Canada?
Again, I will be in a few weeks. Should I answer yes and put my birthdate, as I'm a citizen and have never resided elsewhere for more than 6 months?

Imm5481 #2 Your current situation.

Again, should I put my employer's information and my start date, which will be in the future at the time of this writing, but will be current by the time CPC-M recieves the application?

As I'm still here and I don't have an Option C, or a letter from an employer, I'm planning to add a note that I can supply this on request, on my return to Canada. I asked a friend to call CRA and they wouldn't allow her to request my Option C, saying I must do that myself. Also I plan to give estimated start and end dates for my 5 years employment history, and an estimate of last year's net income. Is that going to fly or not?

I've been working 2 jobs, 7 nights a week, 6 months of the year for the last 5 years so that I could be here with Jo in Thailand. We got married last October.

(BTW We just visited a consultant yesterday, but I forgot about this. He smiled a lot while looking at our pictures, and said we shouldn't have any problems and that our dog was quite handsome. He was so nice, and didn't ask any money of us. I would happily recommend his services to anyone needing guidance. He's based in Bang Sue, Bangkok.)

Everything you put on the forms should be accurate at the time you sign them and put the date on them. If something is going to be true AFTER you already mail the application, then you can include a note saying so, but the forms should have the current situation.

When are you planning on mailing the app? If it's after you return to Canada, then you can redo the forms - leave the date and the troublesome fields empty and just fill them in when you're back in Canada and those things are true.

My husband requested the option C over the phone and it was sent to him. Of course, he was in Canada at the time, so it was no biggie, but they might mail it outside of Canada. Have you tried asking? If not, have them mail it to your address in Canada - that way it will be there when you get home. This form will be needed in the first step of the app, in Mississauga and while it's ok to not supply it if you can't, you should still try to get it.

can-80, option C can be requested by the sponsor through Canada Revenue at 1-800-959-8281. It is part of the sponsorship requirements.

can_80_n, it is a form that the sponsor has with Canada Revenue, if they filed their taxes last year. Apparently it is a more detailed breakdown of their earnings, and it is a very specific form that you need for sponsorship. The sponsor will likely have to call for it, as it is not usually returned when they file taxes. When my husband called for it, we had it within 2 weeks, so it should not take long.

For the 2 following questions... Are you just visiting your spouse? Or are you living there. If Canada is still your home and you have an address there, then you are currently living in Canada, you're just abroad for a visit. (my husband was with me in Canada when we filled out his forms, however he still lived in England at the time - he was jsut visiting)

Don't panic about the employer stuff... thre is no income requirement for spousal sponsoships. With that being said - I would be sure that you include a note explaining that you will be employed as of xx-xx-xxxx.

You have to have an option C if you have done taxes, and a letter from your employer is a good idea as well - however in your case the offer letter would be good. Get all the nasty stuff out of the way, getting those things you can do in the first few days you are home. The option C only takes a few days.

I just would rather get everything done and send the application without waiting for letters and Option C printouts and the like. These are not really necessary for the spousal class sponsorship, and I will supply CPC-M with the Option C and employment information when I am able. I figure that's okay. What do you think?
I don't have a letter promising employment, but it is agreed that I would return to both restaurants and cook for them, I'm good and they count on me in the summer months when it's way too busy. I'm visiting here 5 months not living here, and the hassle of getting through to the CRA for my Option C is just not worth it right now, I am told I would have to redial up to 20 times before I get through and who wants that kind of hassle? Not me. She's my wife, and they are going to allow her to come to live with me, and this information isn't a make-or-break issue. Right?

The immigration consultant recommended that I get this sorted quickly and file the application ASAP from Thailand because my wife and her son have already had their medicals done, 2 months ago.

He said CPC-M would contact me if they require the Option C or letters from employers, but that if I didn't file soon, it might cause delay in obtaining her PR visa because the validity of the medical may expire if the Singapore office is slow to process.

True, the medical exam is valid only for 1 year and if the visas have not been issued by then, they would have to redo the medical.

But keep in mind that sending an incomplete application also causes delays - Mississauga tends to just send the whole thing back if something is missing. Even if they just send the request for the Option C, it will take a while for you to get that, then it will take a while for you to get the Option C and then it will take a while for you to get the Option C to Mississauga. And it doesn't take long for Mississauga to start processing your file, they usually get to it in a month after getting it and if everything is OK, they forward it to the visa office the same day.

As you've been out of the country for 5 months, I'd try to get that letter from your employers. If nothing else, an email would do. Because you've been away for so long, the IO might see it as you living abroad and might want to see some proof that you intend to go back to Canada.

On the other hand, you might be just fine - Mississauga might not need the option C from you and you might not even need the letter from the employer. But if you'll need either, it WILL cause delays for sure if they have to request them. The risk is yours to take.

On reviewing the guide, I've decided I will complete the application and send a letter from my employer and the Option C data on my return to Canada. If we have to redo the medical exams later, so be it. I understand now that if I send the application without Option C and other information, CPC-M may just send the whole darned thing back.
