Hello all,

Regarding IMM 5409: My same gender (Chinese)common-law partner and I have already cohabited together in a conjugal
relationship In China for 32 continues months.We are temporarily living apart,he in China ,I'm living in our home in Saskatchewan.I'm a Canadian citizen
My question. How can we complete the Statuory Declaration Of Common-Law Union IMM 5409 ?We need to sign this document befor a Commissioner of Oaths,how can we do that? Let me add the Chinese people in China are a little hostile towards same gender couples!

The Chinese Government does not allow any kind of same gender union ,not marriage or common-law or any other kind of union .
How can we go befor a commissionar of Oaths to declare our Common -law union ?

The Canadian Government rarely allows a Chinese national a visitors visa.It is a little bit easer for Chinese people to go to South Africa (not much easer) South Africa also allows gay marriage and Canada recognizes these Marriages.
Surely we wont have to go to that extreme .If anyone can help with this question ,we would be very happy to hear from you.

Good News :

The Statutory Declaration of Common-Law Union (IMM 5409),to be completed only if you have a co-signer and he or she is your common-law partner!

That means my same gender common -law partner and I need not fill out this form IMM 5409 It is N/A

One last thing about same Gender unions ,the Canadian government will recognize your common-law union no matter where (what country)on earth you cohabited in a conjugal relationship for a period of one year (thats 12 continues months).
The Canadian Government will recognize your same gender Marriage only if it is leagal for same gender couples to Marry in the country your Marriage took place in(ie South Africa).
