I am a Canadian living abroad, we have started to complete the papers to bring my Spanish husband into Canada. we are married in canada and Spain and our two children have canadian citizenship. In the section as sponser, I am unemployed. Im a house wife, will they refuse my application even though my husband makes more than adequate money? We plan to move there to live so we dont know if he should enter on a work visia and get it changed into PR or do we have to wait in Spain until we receive word that I have been approved as a sponser? So confussed

Your husband isn't eligible for a work visa unless he gets a job in Canada and the employer gets a labour market opinion for him.

You do not have to show income but you can write a cover letter explaining that he is the breadwinner in the family.

My advice, don't go until he gets his PR visa. It is not easy to get a labour market opinion for a work permit so if you go as soon as you apply, before he gets his PR, you may be staying in Canada for months without any income unless you decide to get a job which I am sure you could.

Otherwise, wait until he has the PR visa, then move, then he can look for a job when he arrives.

Re: How to prove we are willing to move?

In the application, it states that we must provide proof of willing to move to Canada after he receives the PR visa. What do they require in the form of proof? He is well educated and an English speaker so he will have no problem getting a job as he had already sent his resume. As well, when he gets the PR visa, how long do we have to move or he begins working in Canada without the visa expiring?
Thanks in advance

Proof of moving could be something like having arranged a job (which is hard for him as he is not a PR yet), having been accepted to a college, having arranged housing or at the very least some supportive letters from friends/relatives in Canada saying the know of your relocation plans and will support you, help you find a job, help you find accommodation or even let you stay with them as you look for a place.

If he has already sent his resume and some company said they will hire him when he gets the PR, that's proof of having arranged a job so get that in writing and send it along.

When he gets the visa, it has an expiry date on it. This is usually a year after he did the medicals for the PR application. He must land in Canada before the visa expires. Upon landing, he will get PR status so after that, nothing will expire any more.

pmb,

Easiest way for this is that you should get a job offer - being a citizen immigration type paperwork (read complications) for the employer is not an issue! Can any previous employer confirm they will give you a job upon return?

Re:My husband is Spanish, we just had him police check done, fingerprints needed

My husband just had his police check done in Spain. We are now waiting for the documents to be authorized before we send them. Does he need to have his finger prints done? We currently reside in Dublin so we had a police check done here as well. Under the sponsorship evaluation form IMM 5481, I am confused as to how many persons are to be counted. I am the sponser, our 2 children have Canadian citizenship and my spouse is the applicant. Total number of persons??????
Thanks

You are just sponsoring your spouse. Since your children are Canadian citizens, I don't think you need to put them.
I would agree with Leon and Msafiri about getting a pr visa before arriving here.

My wife is US citizen and we thought it would be easier for me to sponsor her in Canada. We arrived here and she came on a visitor status for six month6 and we waited for more than a year to get all paperwork processed for her permanent residence. She couldn't work during that time. So it is best to get a pr visa so when your husband is here he can immediately get a SIN and start working.

As for the income for a sponsor, I heard conflicting opinions about it from CIC when I called them. One agent said that it is not necessary for a spouse to have income to sponsor a spouse. The other agent I talked to said one has to have income and if a spouse doesn't have income to support spouse then sponsoring spouse should get a cosponsor/cosigner like a parent. I would contact CIC about that to be absolutely sure.

Good luck!

The co sponsor is not an option for spousal applications. CIC is concerned about the ability for the couple (or family) to survive without resorting to social assistance. In making this determination they will consider the income potential of both sponsor and applicant. If family offers assistance while the couple get settled, that is considered as well.

I have seen many couples in exactly this situation successfully obtain PR for the sponsored spouse/partner.

Finger prints needed along with police check from Spanish applicant

My husband is Spanish and we just received his Police Check, I have been reading and now wonder if he needs to submit finger prints? We now reside in Dublin, Ireland, not in Spain or Canada for that matter-

As part of the sponsorship process he needs to get police clearances from the relevant jurisdictions that he lived in for the time period CIC specify. Some of those jurisdictions require fingerprints to prcoess the clearances especially if your husband has a profile similar to someone with a record e.g name/ DOB etc while some jurisdictions don't and work of a name/ DOB check only. The relevant jurisdiction in this case Spain or Ireland or any other country will detail what you need to do to get the clearances processed.

Check the sponsorship forms for the visa office (which I expect to be London) processing your application it will tell you what checks are needed and whose responsibility it is to forward those clearance checks once obtained to the visa office be it the applicant, the police or even CIC themselves asking for those records.

When in doubt read the instructions. There are are forms/ guides specific to Western Europe. Some of the instructions in this region specific guide are for specific visa posts e.g. Form 5562 applies to those submitting their application to Paris...which visa post are you submitting your application?
