Im getting married in FEB 09 , woopie!! or maybe not, some advice?

This is my first posting and I gotta say im really happy this place exists.

Im a Canadian citizen residing in Montreal and I will be headed to India in the mth of FEB 09 to get married there. My question is, will it be possible for my wife to return back to Canada with me? This relationship has almost been 4 years in the working and I dont think I can go past FEB without her.

My intentions were to have her apply for a tourist visa and then once she's accepted, she can return with me at which point we can apply for PR.

Any help in this matter would be really appreciated!

First off congratulations!

I don't think your wife can come back with you unless she plans on doing so temporarily; in other words just visiting. I beleive you will have to go through the sponsorship process and for that she will have to be still living abroad (in India). It's faster to apply for a spouse living abroad than within Canada!

This is the difficult part for all of us that are married with a spouse abroad (I've been apart from my husband for a year and a half, we were married in June); the wait while CIC processes the application is dreadful!

After you're married you'll have to follow all the steps to sponsor; it would be a good idea to read the guide beforehand so that you can get a few things done prior to you heading to India for your wedding - she'll have to have a Medical done, a police check, pictures taken, etc. (all this needs to be included in your application). The reason it's best to get all this done beforehand is so that you don't suffer any more delays in bringing her here with you.

I confirm that msgomez is perfectly correct,Here TFW visa would be 99% denied unless she could prove she was returning to India after her visit.

Hi,

In this case, would I have to go to India, get married, then return with the marriage license and then apply for sponsership, then once this would be approved, she would be able to come here?
or
Can she come here on a tourist visa, get married to me and then just apply for visa extensions as required? Would this be a viable option?

I hope your husband and yourself will be together soon.

you should 1st apply thru quebec ministry of immigration,get a letter of acceptance and then send it in with the application.

In regards to the last comment posted, can you let me know what application would I have to apply for within Quebec? Does this also mean that I would have to apply separately with CIC?

Hello again!

Yes, the CIC application is the 1st step and the Quebec forms are the 2nd!

If you're a resident of Quebec the steps are a little bit different than the rest of Canada. The 1st step (The Sponsorship application) is the same for everyone across the board in Canada. It is the 2nd step (after CIC has approved you as a sponsor) that you will have complete as well - these are separate forms that need to be completed by Quebec residents only. You complete the required forms (one of them requires your wife's signature) and return them to the Quebec offices along with a copy of your acceptance letter from CIC and a payment of $250.00 (yes... yet more money!).

Your best bet would be to read over all the information and bring these forms with you as well to India so that you and your wife can complete them there, so you can bring back with you. This avoids you having to send forms and documents back and forth between here and India for signatures and so forth. It's best to avoid these delays if you can.

I hope this clears things up for you. As for your 2nd question above regarding the 2 different scenarios: your better off continuing with your plans to marry there, return with your marriage certificate (which you'll need to submit to CIC) submit your application with all the necessary documents in order to sponsor and bring her here.

Plan A would be to have her apply for a vistor's visa into Canada, then I would go in FEB 09 and get married to her and return with her on the same flight. She would of course stay here and apply for visa extensions until PR has approved.

My questions are the following\;

1. Whats wrong with this scenario?
2. Will it take longer to have the PR approved in this fashion?
3. Is there any risk of "defaulting" as she would be misrepresenting her intentions as reason coming to Canada
4. Is there any risk of her boarding the same flight with me?

Plan B would be to get married there, return on my own to Canada with the marriage certificate and then apply for sponsership.

1. During this application process, would she be able to visit me here?

My goal like everyone else is to be with my love asap , though I do not want to jeopardize anything as a result of haste.

You are assuming she would be approved for a visitor visa to Canada. Travelling alone, CIC will find it suspicious that she is going on holiday unless she is visiting someone, then who. It's sometimes ok to not give CIC complete information but it's not ok to lie. If the embassy asks her who she is visiting, she must tell them. If they find out she is planning to visit a boyfriend/husband, she will probably not get approved for her visa. If she got approved, no questions asked, no problem. If she doesn't get approved, back to plan B. If you marry her and then apply for the visit visa, same rules apply, they will not let her visit when they know she is planning to stay. However, depending on the embassy, you may be able to get her a visit visa with dual intent after you have applied to sponsor her. You would have to wait for the 6 weeks of sponsorship being approved, then see if she can join you in Canada. If she gets called for an interview, she will have to go back to India though.

Plan A will result in 99% visa denial,sorry to burst your bubble but you obviously are not familiar with CHC ,i know somebody who has been waiting 14 months for his wife to arrive

I am from India too and I was also very much looking forward to spend my days with my husband ASAP. I also wanted to apply for a tourist visa and then get married. However, after much investigation we have decided that its better to apply through New Delhi and go through the complete application process.

Like Leon said, IF the embassy asks whom she is visiting she cannot/should not lie. Duel intent is an option but she will have to go to India if called for an interview.

We applied in Jan08 and I got my Visa in June08. Its really not very bad. It was very difficult to stay apart after being married but think about it, its 6 months wait and then you are together.

Hi Wrebbit1,

I have got married in Canada as my busbad came here on Visitor Visa. Actually, he was visiting his sister and we decided to meet here only, our marriage plans were not sure. Finally we got married here. But he went back to India before his vistor visa got expired and after that we filed the application. It takes long time if your file IN CANADA application.

So the points to be noted are,
1. It is very difficult to get the visitor visa if she doesn't have anybody known here.
2. If she will come here on visitor visa and get married and if she is living here only, you will get the extension of her visitor visa, but it takes a long-long time to get her PR status (from one year to three years), and she wont be able to do the job. Sometimes, they give open work-permit too! But it's tension of 2-3 years to get the PR approval.
3. If she gets her visitor visa, and then you go there and get married then too you can't bring her here, as her file will get processed over there and they will need her passport once the visa is approved. And INDIAN PASSPORT CAN NOT BE SENT THROUGH ANY COURIER SERVICE INTERNATIONALLY. They may forward your wife's case to Canada and again 2-3 years waiting!!
4. The best thing is to go there and get married, it shouldn't be much of problem as you are in touch with her since last 4 years, please keep all evidences (e-mail, phone-bills etc.) and you will get the visa sson! Best Luck!
