Hi guys!!!
Im sponsoring my husband but i want to go home next year for a church wedding. We got married thru civil rites..i am so positive that at that point in time he is still not done with his papers.. My question is as a sponsor, can i leave canada? Im a pr. Need to know the answers now cos wedding planning takes a lot of time and money and haggling with your boss for a vacay..lol.. Thanks! ;D

Hi

As a PR, you can only leave for a short visit, no more than a few weeks. If you go for longer, then they can cancel the sponsorship app.

I had to go looking for that one. Other than PR residency obligations, I couldn't find it. A PR sponsor appears to me on CIC's web-site the same as a "citizen" sponsor.

Just saying . . .

Nope - not the same at all. A citizen can be living outside of Canada and still qualify to sponsor. A PR cannot. Leaving Canada for too long as a PR can result in having the application refused due to non-residency. This is completely different than the PR residency obligation. Based on the experiences on this forum - a few weeks is fine - a few months is not.

My cousin sponsored me as sinp and by the time she passed my papers she went home to get married. She stayed out of canada for 2 months..i thought it was okay cos she got back with no problems at all hmmmmm..weird right?

as a pr you cannot leave & stay outside canada for long & may be refused. you may stay out of the country (canada) about 2 weeks only, though you are approved as a sponsor.
bcoz i've seen these for many posts by many people who were refused for this reason.

It is up to the border agents to let people back in or not. You were lucky - do not rely on that to decide how long you can stay out of the country. There is no set time limit - but a two-week vacation would be fine; a six-month visit would not be. 2 months? Hard to say - it might be OK for some people, whereas others would be rejected. Also keep in mind that the problem is not that the PR sponsor will not be let back in to Canada - the problem is that if the visa officer thinks the PR sponsor is living outside of Canada, the applicant`s PR application will be denied. So your cousin was allowed back in because she is a PR and a PR only has to stay in Canada 2 years out of every 5. But the danger was that your PR visa application might have been rejected because your sponsor was out of the country.

Now that you are the sponsor, if the visa officer thinks you have been out of Canada too long, it is the applicant`s PR application that will be rejected.

Thanks! I guess everything is a case to case basis but to be sure i better follow the rules..this is saaaaad! :(

I called cic today and of course an agent answered. Asked him
The same question--can i go out of canada even if my husbands papers Are in process.. He said---youre a pr..no one can stop u..u can leave whenever you want..im like--are u sure? Cant he get denied? He said--no..why would he be denied? So i said--because im leaving the country! He said--it wont affect his papers..and im like--are u really sure??? He said---look u can leave and his papers are still ok!!!

I pissed him off i guess. Hahaha..Errrrr..ok..whatever u say cic guy..im calling again next week! Lol

No matter what the call centre people tell you, follow what it says in the manual I posted, as it contains the actual rules that the visa officers follow.

The call centre is useless. You will get a different answer from 3 different agents to the same question.

dont be fool to follow there nonsense. they dont care whether your spouse get his visa or not. or your spouse go to canada or not. though you ask from your visa officer (if you can meet them- but you never meet them unless you go for an interview), they never give you the correct details. they dont have an intention to give you'll the visa.
but luckily most of people who is in this forum knows very well than CIC reception about the way of visa process going on.
so, listen to these people.
