Ilegal in USA, applying for PR in Canada

Hi everyone,

I have been applying for Permanent Residency (PR) in Canada since February 2023. Initially, we applied for a Work Permit (WP) but was refused due to a minor criminal record that my husband (Principal Applicant) has from years ago in the USA. I applied for a WP a second time but was refused again because I don’t have legal status in the USA.

Despite this, I continued with my PR application and, in June 2023, I also submitted a Criminal Rehabilitation application, which has not been approved yet.

Currently, I am living in the USA. I applied for asylum here, but my application was rejected, and I was given a date to leave the country. However, we still here.

The IRCC is fully aware of my status in the USA and has requested additional documents multiple times (5 times in total). The most recent request was for our Background (since we were 18 years old), Family History, and Travel History.

Has anyone experienced a situation similar to mine? It is so frustrating that, even now, we have not received a breakthrough for our application.

Some could say that you ignoring the date to leave the U.S. is frustrating.
Have long have you been there?
Did you ever have legal status?

You living in the U.S. without status means that you will be banned from returning, if you ever wanted to return, which ranges from 1 year to a possible lifetime ban.
Your nemesis (now) is Homeland Security, or CBP.

You may have better luck asking a qualified lawyer about your situation, since most of us here are NOT lawyers.

Almost 3 years living here. While I was waiting for approval of my application (USA) I was allowed to wait here in USA.
I already have lawyers for my case in USA and CANADA. My question was for people in same situation as mine. Because even the lawyers can’t say too much, they didn’t have cases like mine.

PNP program. We received our PAL yesterday. Med passed. Security not started. Info share in progress. Criminality in progress.
And yes we have valid passports
