If my wife is waiting in Canada while going threw an outland application process and the 6 months of her tourist visa expires, will she have to leave the country until she receives her residency card or since I am a born citizen (her husband) she would be able to stay in the country with me?

I know that it would be wise to apply for an extension of her tourist visa and describe the reason why I want her to stay past the six months, but if they do not grant her the extended stay beyond the time allowed then will she be forced to leave Canada or since I am a born citizen and her husband will she be able to stay with me?

Well the good news is that while your wife's vistor's extension in processing, she can stay in Canada. And that usually takes 3-4 months.

However, if they do not extend her stay, she will have to leave. But, the good news is that if you show that you have filled out the outland application for PRS, they are unlikely to deny your request for an extension. But if you just filled out outland and submitted it, depending on where you submitted the application, it could very well be that she's granted PRS before you hear back from the visa extension people. But like I said, if you can prove you submitted an application, it is unlikely they will deny you.

Thank you so much for your great response! I am actually going to send the Outland application package in April once I arrive in Canada with my wife. Do you suggest we apply for an extension right away once we arrive to Canada or wait for at least 5 months to pass and then apply for the extension?

Yes of course that is what I was thinking of doing. It makes more sense to wait until the last month at least.
Is it true that the pictures of proof of a genuine relationship has to be of the both of us in spontaneous moments and not posing?
Does it really matter if we are posing in a lot of our pictures? I don't think that our relationship of 7 years should be judged of not being real just because we pose in pictures?

The proof that is required is based on far more than just pictures, posed or not. So there is no truth in what you suggest, a mixture of all types of images is good.
Try and remember, the genuine nature of a relationship is not about what we think, the VO will judge that.

Make sure that the extension application arrives before the current status expires, use a method of posting that has proof of delivery / signature.

soo true!!! it's based far more than just pics...I don't think they can just come to a conclusion by only the pics..all the other info along with the pics should do justice! I and my husband usually vacation by ourselves and there wasn't anyone around to capture spontaneous moments ::) so, in most of the pics we were posing..
But to think of it...the VO must be handling hundred of cases..would they not know the diff between a genuine relationship and a fabricated one?
