Please,please help me with an answer...I received the removal order 2 days ago,because they rejected my Refugee claim.I have to go on Nov.26 for the interview at their office at the airport.I will go,and I will follow the rules,because I am married,and we did not have time to apply for sponsorship ,and I do not want to have any problems,because I want to come back here,cause my family and my home is here.
If I follow their orders,still I need an ARC? I have any interdiction to come back in the right time,when the sponsorship will be done?
If you have been trough this,can you give me please an advice? Thank you for your help! :'(

Hi. we were in the same situation
My husband got a removal order as well. denied refugee.
We are almost done our sponsorship now.

Yes you will be asked for the arc.
but they wont ask you for it untill they are done processing your sponsorship application, it is the last thing they ask before they approve your visa to return to canada.

May I ask what country you are from ?

We are applying through mexico and for mexico the ARC takes about 2 months to approve. but some places take less time and others more.

O okay, yeah im not sure the processing time there, but it shouldnt be very long either.
its mostly the middle east or africa that seems to have longer processing times.
I know brazil is only about 2 weeks.

thanks,I will try to get more informations,about outbound as well because I did my medical exam here in Canada ,we were ready to apply inbound,my medical ex are already at the immigration,now I have to change the documents,for outbound,and I do not know if i have to take another medical exam in Romania when i ll get back there.I know for sure i have to do another one for my son ,cause what I have now is not the good one,anyway,I have to find out if I can write down here all the outbound documents and let them to my husband to send him to Mississauga.I am ssoooooooo confused\! :-\

Hi Leisa,

I am reading about ARC in their site and they say we do not need an ARC,just if we do not obey their rules.I mean if you leave Canada after 30 days of your removal order.I have a removal order,but they ask me to go to an interview.I will go and I will do exactly what they want.If they give me a day to leave the country I will ,cause I do not want to have any problems.I want to come back as soon as my sponsorship will be approved. I do not want to waist my time here,for nothing,instead of going back to my country and wait for the sponsorship results.If your husband needs an ARC,that means your husband did not leave Canada in time ,right? Thank you again for any information you can give me.Good luck!

Yes, I know what it says and unfortunatly thats not the truth.

There are about 5 of us on the mexico forum that all left within the 30 days, paid our own tickets, checked out at the airport, followed all rules, and all of us have been asked for the ARC.

what they say on the website contradicts what they do in real life. im sorry to say it but we thought the same thing

My husband was denied refugee, he went to his interview, cbsa told him he has 30 days to leave, we bought our OWN ticket, left under the 30 day mark, went to the airport office to get the proper documents to check out of canada, did everytime exactly by the book.

and we were still asked for it, everyone that is denied refugee, it doenst matter if u leave on time or not, you will be garanteed to be asked for the ARC. I have yet to see this not happen and I have been following arc cases for about 1 year.

its really a pain honestly. we were expecting not to have it either because we did everything by the book, but we just got asked for it 1 month ago and its currently in process.

The good thing is, it doesnt take long to process it!, and if you are applying under spousal sponsorship, your almost garanteed to be approved. :D

I think what's confusing to anyone under refugee is that they must realize that when applying for refugee after failing the initial refugee hearing you have 30 days to leave the country.

if you decide to stay and appeal and also go through the PRAA, at that point you are overstaying. I think people feel that once they are legally there fighting to stay in Canada that they are still legally there however you're not. Once the 30 days after your denial arrives, you are pretty much overstaying.

hi how mny dys after your refugee claim ws denied you received yor removal order am afraid my bf may receive it too bec he was rejected too.

Hi,
Pls I need help to get this sorted out. I came to Canada in 2006 as a Student on Study Permit and I did not get done school yet so I applied for OCWP and was working since beginning of last year, I got married to my wife who is Canadian in January before my OCWP expired in Sept, I tried applying for an Open Work Permit to keep working since I was not in school I could not apply for OCWP, but Work Permit was denied I was told to reapply again with LMO and restore my status and my company wont apply LMO for me because they say my position can easily be filled with a Canadian I cant go back to school yet cant really afford it, so my wife is going to sponsor me on Family Class PR, but which office do I send my application to, am Nigerian and here in Canada I was given 90 days to restore my status and apply for a permit, but we want to apply for the PR Family Class, will it work this way ?? Which office do I send my application to, the Canadian office in Missauagua or the office in Los Angeles, What do I do, Pls I need help!!!! Pls thanks a lot.

I am a failed refugee and H&C applicant who will now be sponsored through the family stream (by my husband). I read on the CIC website: "If you are applying to come to Canada for any reason, (visiting, studying, working or immigrating),you should not submit a separate application for an ARC. If your application is approved, the ARC will be dealt within the context of that application. You will simply be asked to submit the fee". But you said you didn't submit the ARC with your application? And that was okay?

Hi, I was also deported from canada last may of 2012 my husband is sponsoring me and we have passed the approval of the application and stuff and medical exams. Last Thursday I received a letter asking me to send them a letter explaining why I didn't leave Canada when I was told so (because we applied for the humanitarian and compassionate permanent residence) and explaining why I should be allowed to be back. I've sent in all the paperwork requested today along with the $400 payment but I'd like to know if anyone knows from this point what's the time frame I'm looking at before they make a decision. Our lawyer says this is all happened too soon that's why I want to get happy but I'm afraid it will still take months. By the way I'm in Colombia if that helps... :) thanks to anyone that can give me any info.

It went fast, Lucky you! I'm on the same boat, but been waiting long as you can see on the left. The VO said the ARC takes a few months. I been asked for the colombian security payment twice, last time on late November. went for an interview on March 2012, the VO asked for my passport during the interview, paid and send the application for the ARC on May, my medicals will expire on April. still waiting. is just a matter of patience.

It's so hard to wait especially reading all this post since you realize everybody's process takes different times regardless of the time they filed. Do you think I'll be asked for an interview? Or do you know if they only do so at the beginning of the process? I hope I don't need one since I don't live in bogota. Our lawyer said it was a matter of a couple of months until I am there but I see that less and less likely every time I'm on this forum and read about everyone's cases. We just have to take things day by day. At least it looks like you are at the end of your process! Good luck!

Hi pineapple87 what is most likely to occur is that a few months into your process they will ask you to file an ARC I was just asked to do so, I am in your same circumstance. When I sent in my application I didn't send anything dealing with the ARC. Immigration itself will ask you to do it later into the process. I was asked to submit a letter and pay a fee of $400 dollars. I hope this could clear something up. By the way my process is in South America so I'm not sure if the way to do things vary by country.
