If I get pregnant while my Jamaican husband is here on a TR visa, what happens?

Hello,
I am Canadian and my new husband is a Jamaican citizen still living in Jamaica. (We married in Jamaica.) Our plan is for him to immigrate to Canada. We are trying to figure out the fastest way to obtain permanent residency for him. I believe that if we are able to get temporary residency for him to visit, we can then apply for PR and he will be able to remain in Canada until the application is processed. Does anyone know if this is accurate? Also, if I get pregnant before his PR is approved, will he be permitted to stay? Would this kick in as a parent Visa at that point? Is there such a thing as 'family hardship' that we can claim to be able to stay together in Canada? Please respond if you have any knowledge or comments. Thank you in advance for your time. :)

Hi Kristy,

It is usually extremely difficult (if not, impossible) to get a visitor's visa for your spouse. Reason being that they don't believe your spouse will return to their own country once the temporary visitor's visa expires. The person would have to prove they had many things to go back to in Jamaica, such as a job, property and even then most people I have heard about get refused right away (Including someone on this forum who is currently pregnant in Canada and soon to give birth, and her husband was recently denied to come for the birth). It's best to go straight for the PR application from this point on instead of waiting extra time for something that is so unlikely.

Even if you were able to get a temporary Visa, They would not extend it due to a pregnancy. You would have the possibility of extending it, but family circumstances rarely have an effect on the matter.

I can tell you it is very hard for a Jamaican to get TRV to Canada. You need to show strong ties to Jamaica that he will return. He will need to show more than he has a job to return to... Now that you are married, you are better off to apply under family class as sponsor him as a permanent resident. Come join us on the Kingston thread. You will see there that some people get through in as little as 5 month or as long as 18 month. But, once approved, your husband can live, work, and/or study in Canada permanently until such time as he qualifies for citizenship.

I also did apply for my husband to come to Canada on a TRV for the birth of our son. Even though we were not married at the time, and he had a job to return to, he was denied for insufficient proof that he would return to Jamaica. I agree with Avana, it is next to impossible but not completely. very very rare...

Hey Jamgirl,

Glad you agree.. I always get a lil nervous giving advice to someone on my own, so its good to know that a senior member here agrees. :D It sucks that they make it so difficult for our men to come and visit, and should trust that they wouldn't break the agreement in the hopes of not damaging the chances of PR.... but they dont.

Here's to getting all this waiting done and over with ASAP!! going to see my hubby in less than 2 wks for a wknd, but I just want him here FOR GOOD!!!

Yes, if he can get a TRV, he can come to Canada and wait in Canada while the application is being processed. However, as noted in the above posts, it is very hard to get a TRV.

If he has a TRV, he can apply to extend his stay (you being pregnant or not). If he doesn't get a TRV and has to wait in Jamaica for the processing, then your being pregnant will not make the process go faster. It does not change the type of visa. 'Family hardship' is not an issue at this early stage. If you apply and his PR visa application is rejected, you can then appeal; humanitarian and compassionate concerns can then be used, based on the best interests of any child. Much better and faster if you don't have to appeal, of course.
If you do get pregnant, this will not hurt your application, but having a child does not mean the PR visa will be automatically given. You still have to prove your relationship is genuiine. Of course, having a child is usually seen as a good indicator the couple is real, but it is not enough.
