If child born in canada, parents are in open work permit

hi there,

i am from India, I am in open work permit last 3 years, and i sponsored my wife as a dependent visa, she is currently in Canada and 5 month pregnant.my question is our both work permit and visa expires by end of june 2014, and due date for my wife is last week of may 2014. i am bit worried if my child born here what would be the status of my child, i know that we cant extend our visa due to this reason, and if anyone know what is next process to take my child back to India?

please give me some one detail info

If your child is born in Canada then he/she will be a Canadian citizen.

Do I need to leave the country by before end of june 2014 with 1 month old new born child? how long does it take to apply Canadian birth certificate & passport for child? till the time we allow to stay in canada?

Yes, unless you apply for an extension as a visitor. Check with the vital statistics page in the Province where the child will be born to see how long for birth certificate. The passport application takes 10 days for in-person applications, 20 days by mail. You will also need to get an OCI card from the Indian consulate for the child.

I dont think the child needs a passport to travel.

But make sure you have healthcare coverage that includes the birth.

1.Currently one of the employer offering me a LMO, is that anyway i can add my wife as dependent with the LMO, as i said before she is currently live with me in canada as a dependent open work permit visa???????

2. i am currently working with one company, but they are not offering me a LMO, but another employer offering me a LMO, but they cant promise me a job there, my question is once the LMO approved from another employer, is that possible to switch LMO to my current employer???????

All babies need passports to travel internationally regardless of age.

1. No, she cannot be added to an LMO. If the job is NOC A, B, or 0, your wife can apply for another dependent work permit AFTER you receive your new work permit based on this new LMO.

2. No, you cannot "switch LMOs". An LMO is permission for a specific job with a specific company to hire you.

Nobody will stop you from leaving with your Canadian baby but as others have said, you do need to wait for the baby's birth certificate and apply for a passport.

You normally have a 3 month grace period to leave after your status expires unless you want to apply to change your status to visitor. However, if immigration asks you to leave, you only have 30 days to do so.

If you get an LMO for a job at another employer, it will only be valid for that job and that employer. You can not change it to another position or another employer. You would need a new LMO for that.

Do you or your wife qualify to apply for PR under CEC or PNP? If you apply and have first stage approval before your work permit expires, you could apply for a bridging open work permit.

Hi There,

Finally I decided to go back to India. I need a help?????? my visa expires 29th June 2014 and my wife baby delivery due is 1st week of June 2014, i don't think i can fly back immediately as my wife & Infant are ready to fly and also i need some time to apply for my son documents as well ( birth certificate, Etc...), could you some one help me, how to Re-store me & my wife legal status for 3 month after June 2014?

I checked with one of the lawyer regarding extend my stay as visitor, but he is saying not possible in my situation? is that true?

OR

Am i eligible to apply for Humanitarian compassionate ground basis to get a SHORT TIME work extension????????

what ever possibility to re-store my status in legal until September 2014, please message me.

Don't go back to that lawyer. You can apply to change the conditions and extend your stay to visitor. http://www.cic.gc.ca/english/information/applications/visitor.asp.


H&C does not apply to you.

Is it anyone know? what kind of documents I should apply for my baby before I leave Canada? i know some EX ( Birth registration, Birth certificate, anything else?

No.

As mentioned before you giving birth to a Canadian child does not get you any immigration benefits.

You can try to extend your stay as a visitor or find another immigration route you qualify for---the child is of no help to you until they turn 21
