IEC Work Permit Expiring 2nd July - Help Needed

Hi first time poster in need of some assistance. I have been given some really conflicting information from CIC directly and by a number of immigration lawyers.

I'll summaries my position as briefly as possible:

• I am an Irish national in the second and final year of my IEC temp working permit. It expires July 2nd.
• I have just been offered a new job. At present the possibility of an LMO through this role has not been discussed.
• My common law partner is also in the second year of her IEC permit but her LMO is in process now.
• She has been issued an LMO number and is hopeful it should be finalised by Aug 1st.

Our plan is to wait for her LMO to be finalised and from the information we have be given i will qualify for an open permit for the duration of her LMO under common law status.
I am aware that i am excluded from applying for a working extension on my own permit without an LMO number.

However from speaking with an agent from CIC today when my partner completes her extension application to cover the interim period between the end of her permit (july 6th) and the start of her LMO permit there is included a declaration of common law.

I was advised that by including my own extension application that would give me implied status while the LMO is in process and i could continue to work.

As mentioned i have had advice from many different sources all of which were different. I would appreciate any help you can give me.

1. No, you can't continue to work after your IEC expires, as it not extendable.
2. You can't apply for the SOWP until your spouse receives her work permit.

I appreciate your response, i notice from scanning previous topics on the matter your a great source of reliable information.

Would you have any idea why 2 CIC agents advised me I could get implied status by doing what i outlined?

Very frustrating when you go to the source and they dont give you the correct information.

Unfortunately CIC agents don't always provide correct answers. There's really no better explanation than that. We hear reports here of the bad advice they give all the time. I think the CIC call centre is a good resource for very simple / straight-forward questions. Once a situation is more complex (like yours), it's a dice roll if you'll get the right answer.
