ICAS could ruin it for us. Send application now and ECA later?

Hi everyone

Here is our dilemma. Out ICAS evaluation has been in the queue for processing since 21st August!. We believe they should commence the evaluation this week, but even if they do we have no idea how long it will take to do or how long it will take for it to arrive to us via courier.

As the deadline is fast approaching we are seriously considering the fact that we may need to send our application now without the ECA included, and then send on the ECA as soon as we receive it. We currently have a fully completed application ready to go, we are ONLY waiting on the ECA.

My thinking is that as long as our application reaches CIC before the end of year deadline then we will go in the queue for the FSW2014 applications. I imagine they wont even open it for a few months, which should then give us plenty of time for the ECA report to arrive and be added to our application.

On sending the ECA I would write a covering note explaining how long we had been waiting for it and why we are having to send it on later. I would include the tracking information for our original application so that it could be easily paired with our application.

My question is, do you think CIC would accept this? They must understand how much effort and expense goes into getting an application together, and to have it ruined by such an atrocious company as ICAS is totally unfair. The current wait times for ICAS assessments is just unacceptable, surely CIC would understand and just add the ECA to my application when it arrives?

It would not surprise me if there are many others waiting on ICAS who are contemplating doing the same as us.

Any thoughts?

No - CIC won't accept your application without ECA. If you send your application without ECA, it will be returned to you as incomplete.

Yes but its not like I am not including it or have not even had an ECA done, I would send it as soon as its received, and they would receive it before even opening my application!, so strictly speaking it wont be incomplete.

I find it hard to believe that they would be THAT uncompromising?

We have spent far too much time and money getting this application together only to have ICAS ruin it now, so we have to at least try.

The ECA needs to be included with the original application or it's incomplete. You can't send it later.

I know that, but we would still try, nothing to lose and all that...

As you have been waiting since August to get it, maybe there is a chance CIC understands. But it is a huge risk. On the other hand I guess it's the only thing left for you to do or you go straight for EE.

If it were me, I would take the risk, but explain really really well the situation and the fact that normally you wouldn't have sent the app without it. What is the worst thing that can happen? To get rejected and go for EE? Anyhow if you wait you will have to go for EE.

If you only started ECA recently that for sure it would be hard to explain, but as you really did it on time, I just hope someone in CIC would understand.

Please take this really as what I would do. Others are right that in a normal situation CIC will reject the app.

Thanks, yeah that is exactly what I was thinking. If I can show them that I have been waiting over 16 weeks for my ECA report and its not a case of me not being organised and leaving it too late then maybe CIC will take pity.

As you said, its worth a try, all they can do is refuse it and then I have to try via EE, which I would have to do anyway if I don't send it.

We are still hoping ICAS will come through and get it to us on time...but hope is fading fast :(

I applied to ICAS first, then realized they will take ages for my ECA, i reapplied with WES and got my ECA within 20 days.

Anyways i believe CIC will not accept an application without ECA report. However you can plead with them by writing a letter explaining them that ICAS has yet to revert with your ECA report. Givent them your ICAS file no and receipt as proof.

I still don't think this i will do but that the best option you got as of now.

Yep. I still have a couple of weeks I can wait for ICAS, but if I don't get anything by then I will have to look at doing that.

PERMIT ME WRITE IN CAPITALS:

SCYLLA SAID IT ALL. YOUR APPLICATION WILL BE REJECTED IF IT DOESN'T CONTAIN ECA. THERE IS NO, I MEAN "NO" EXCEPTION, EVEN IF YOU WRITE THE MOST CONVINCING LETTER IN THE WORLD.

MY ADVICE: KEEP ALL YOUR FSW PREPARED DOCUMENTS SAFE, AND WAIT FOR ICAS TO SEND YOUR ECA. IF THEY SEND IT BY END OF MONTH, WHICH I STRONGLY FEEL THEY WILL BEFORE 20TH, INCLUDE IT AND SEND YOUR FILE.

IF YOU DON'T GET IT BY MONTH END, YOU MIGHT BE LUCKY THAT FSW2014 BE EXTENDED INTO AN EARLY DATE IN 2015! YES. THAT IS ONLY IF YOUR NOC IS NOT CAPPED YET.

ALSO, YOU CAN JUST WAIT FOR THE ECA AND GO IN FOR EE STARTING IN JANUARY.

DON'T EVEN TRY TO SEND YOUR APP WITHOUT THE ECA IT WILL BE SENT BACK TO YOU. THAT WILL BE $ WASTAGE AND TIME WASTAGE AS WELL.

HAVE YOU TRIED EMAILING OR CALLING ICAS TO FIND OUT WHAT IS DELAYING YOUR ECA? MAYBE IT CAN BE THERE LYING IN YOUR MAIL BOX. I KNOW SO MANY GUYS WHOSE ONLINE STATUSES ARE SHOWING "PLACED IN QUEUE FOR PROCESSING/EDITTING" WHEN IT WAS ALREADY ISSUED AND MAILED. TRY TO VERIFY WITH THEM

AND LASTLY, YOUR APP WILL BE REJECTED WITHOUT ECA, NO MATTER ENSTEIN'S EXPLANATIONS!

I am in the same boat. My CC was charged by CES on the 23rd of September and nothing till today. They wont even reply to emails or pick up phone calls. I have spent a tremendous amount of money and time on collecting my documents and I am really getting desperate now. I will be doing the same. On the 20th of December I will mail via courier my application without the ECA. I will attach all my correspondence to CES alongwith my cc receipt.

My question - what should I do in the document checklist? Tick it and put an asterisk with explanation or not tick it?

I spoke to ICAS yesterday and they seemed to think I would get my report next week, although I am not convinced.
I am still undecided as to whether I should send it without the ECA. If you plan on doing so then yes, I would make a note on the document checklist. Also be sure to send as much correspondence with CES as you can to show why you have not included the ECA.

You cannot send any document at later stage which is stated as mandatory.

I would say wait till 22nd/23rd December 2014 for your ECA Report and as soon as you receive that, dispatch your application to CIO.

In mean time, make your application completely ready so you just have to insert one paper inside your application at the dispatching time.
