What will happen to all the clients who no longer qualify because they are not on the 38 list?

I can't see this being good for business. I hasten to add I am not currently using lawyer, but I think there are going to be headaches and heart aches all round.

There will probably be quite a few people asking for refunds of their lawyers fees. It's a question if the lawyers all knew that the rules were changing. It wasn't introduced too well. If they knew that they were changing and didn't tell their clients about it, that would be dishonest. In some cases they may have told clients and clients decided to apply anyway hoping that they would still qualify.

Well my lawyer send me this the day after the new rules came out:

I am writing to you today because the Minister of Immigration just announced changes to the Federal Skilled Worker category. These changes apply to all Federal Skilled Worker applications received by the Visa Office on or after February 27, 2008. The changes do not apply to any other category of Canadian immigration, and so, if your application has been submitted under any other category of immigration, please disregard this message.

I value our relationship, and part of my responsibilities toward you is to keep you advised whenever anything occurs that may affect the processing of your application. Attached, you will find a document that will answer many of the questions that you may have. Please rest assured that I will be reviewing your application in light of the new rules in the near future, and you can expect to receive additional communications from my office as we continue to work with you, so as to fulfill your goal of immigrating to Canada.

Yes I am. CIC receive my FSW on June 2008 and got my AOR on November 3 with a letter saying to wait for the new rules. BTW I'm in the list..Fiuu!

So you have date before Feb 27? Did you check the H1B program with Alberta? I'm using that one too, and let see which one comes first, Which part of Canada are you looking to settle?

If you get an IA from Alberta, that means you have to drop the FSW application. you cant apply for cic twice.

I'm really sorry that i went with Abrams and Krochak. They said would refund my legal fees if I was turned down for Canadian Permanent Residency.............now they are telling me that legal fees paid already will not be refunded.

Anyone here who used different immigration lawyers who promised a money back guarantee? If so what is their stance on refunds in light of the new rules?

Do you have contract with your lawyer that if your application is refuse by CIC they will refund their legal fees? If you have, they MUST return your payment.

* Instructors teaching non-academic or non-vocational courses (in 4216 Other Instructors)
* Secondary School Teachers (4141)
* University Professors (4121)
i applied under 4141 but its not in the 38 list.
