I need urgent advice re IEC and technical issues with MyCIC Acccount

Hi there,

I am in a difficult situation. I am from Germany and I got here in April 2015 and I have applied for a work and holiday visa to get here. I found a job within two weeks as an account manager, which I resigned from yesterday, because I found a new job (finally the job that I wanted and for a company of my dreams!). So all good there (I have a job offer/ signed contract). I applied in December 2015 for a IEC visa. This looked to me by far the most logical visa to get after the work and holiday visa. However, unfortunately I missed the invitation letter (got in my Spam) and so the invitation expired. Which is no problem they said in the letter, because I can just re-apply. Which I did. But the system in my CIC account doesnt let me. Whenever I try to apply again at the end in the last step it always says this: You are not eligible to submit a profile to the IEC Pool because you already have a profile in the pool. Funny though, in the letter that I got it clearly stated I am not in the pool any more and whenever I go to my Dashboard > Submitted Applications > IEC I can see that it states under 'I am a Candidate?': You are no longer in the pool. Must be a bug I thought. The help center is of no help. They say that I should just withdraw my submitted application - easy peasy. I tried that, but where is the withdraw button??? There is non!

I tried to contact the Technical Service via a web form which takes up to 30 days for them to reply and I am worried here.

My boyfriend has a job as well and is in the process of getting his international experience canada visa. He is almost done with the application.
Now I am worried, that my Visa will run out (valid until end of april 2016) and I will need to leave Canada.

Is there any other chance to speed up processes? Or to apply for another visa? Please, any help is so appreciated!!! I finally found the job of my dreams. I really would love to stay here in Canada...

Thanks!

Irene

I don't know about IEC, but you can try:

- Delete previous online profiles (IEC, Job bank....)

- Sent a withdrawal application thought:
https://secure.cic.gc.ca/enquiries-renseignements/canada-case-cas-eng.aspx

Other options:
- If you have a English test you can create a EE profile and see about your score). In any case I recommend you to do it and take English test if needed.

- look information about PR, federal and Provincial programs.

- BEFORE your current WP expires, if you don't have anything better, apply for changes of status to visitor, you can get extra time to fix issues.

- A posible trick, if you're working you can apply a week before your current WP expires for a new OWP, this application will be refused (some time before the end of current processing time 154 days), but in the mean time you'll get Implied Status and can continue working.

If you try this "trick", you MUST apply for the status change to visitor BEFORE the OWP application is rejected, otherwise you'll be in Restoration Period and it's not guarantee you can change your status at this point.

EDITED FINAL PARAGRAPHS ARE WRONG FOR ICE.

- IEC is not an immigration program
- IECs have nothing to do with Express Entry or Job Bank
- IECs don't require language tests
- IECs don't require LMIAs
- There is no implied status with IEC visas. So applying for a new work permit before the old one expires does not allow you to keep working.

I second everything Syclla said and will add that the new system has that technical error across the board.

People that have been rejected, have declined the ITA or not responded are showing up as already in the pool when they re-submit. It's been going on for a while, not sure if there is a solution yet.

To report technical issues you can use your MYCIC account or perhaps

https://secure.cic.gc.ca/enquiries-renseignements/canada-case-cas-eng.aspx

My previous suggestions were based on my assumption you're currently on Temporary Work permit, so please disregard it

But still being possible do that:

BEFORE your current WP expires, if you don't have anything better, apply for changes of status to visitor, you can get extra time to fix issues.

Also you can try to apply for PR, creating a profile with EE, but you need a English Test

1. If you have already received one IEC under the working holiday visa for 12 months, you are not entitled to a second one. You can only apply for a second on under either young professionals or international co-op

Guys, thanks for your feedback.

I used the link you mentioned before to the web form/ technical support already and have explained the technical issues I have experienced. But this cannot be it? I mean it is clearly a technical issue! Did somebody of you have experience with the technical support via that web form? Do they need a long time to respond? My issue is ridiculous. I am eligible for the IEC visa (before I only had the work and holiday visa) I just need to have the system fix my status.

Also, regarding what Scylla said:
"There is no implied status with IEC visas. So applying for a new work permit before the old one expires does not allow you to keep working."

In just talked to the Canadian Immigration Hotline peeps, and the guy told me that when I have applied for a new visa before the old visa expires, I am allowed to continue working.

If I could count the number of times I've heard stories here where the call centre has given massively wrong info - I could retire today. They are good for extremely basic questions only - this is not one of them. You got the wrong answer. There is no implied status.

Are you sure? :((((( This puts me in a very bad situation! I could cry right now. I missed the stupid invitation email and now I cannot re-apply and everything is in jeopardy? I do have a job offer, I just need to get the visa. Is my only best bet to wait until the technical support kicks me out of the pool, so I can reapply? Does anybody have any experience with the technical support? How long does this take?

Thank you!

100%. We've had several people here run into issues who thought they had implied status. CIC made it clear they had actually been working illegally. Not everyone is caught - but those who are pay quite a price.

IECs are a special class of visa that cannot be extended - and therefore doesn't benefit from implied status.

To continue working without a break - you must have a new and approved work permit in hand before your existing one expires. Sadly I cannot answer your technical questions. Good luck.

I found this one:
Let's say you had a normal TWP which was expiring, and your employer was going through the process of getting you another work permit. TWPs can be extended, so if you apply for a new work permit, you can extend your current TWP to cover you in the interim. You are bound by the same conditions as the original TWP for the time you are implied status, until your new WP is issued.
But, you are not on a normal TWP. You are on IEC, which is valid for one year, and one year only, with no extensions. Therefore, because there is nothing to extend, you can't benefit from implied status.

I am here with a TWP (Work and Holiday Visa) which I am extending. In other words, I am waiting for my IEC Visa, but I am here on my TWP...which means I am under the implied status, doesn't it? Only if I would be here with a IEC Visa and waiting for another Visa (the other way around) I don't fall under the implied status?

What do you think?

You are here on an IEC. An IEC is the same thing as a working holiday visa. If you were here under the TWP program, you would have obtained a full time job offer + an approved LMIA in order to then qualify to apply for a closed work permit tied to a specific employer (which you would not be able to use to work for any other employer.

1, I think that the OP is missing the point that is probably not a "technical issue" as a German citizen is only eligible for 1 one year working holiday working visa.

Irene, As we can see looking in this forum, information provided by CIC call Centre are contradictory and confuse.

Just try to call again and explain your current WP is IEC, perhaps you'll get a different answer.

I'm assuming Scylla is right, so look like it's a complicated situation.

Scylla, what do you think about applying for visitor visa?
Should be a New visitor visa (7 days process) or a extension (115/136 days)??
