Hi

I need your advice....I landed in Montreal on 2 May 2010...and Left for my country on 26 March 2011. I came back to Canada but this time to Toronto on 13 April 2014. My PR has expired on June 2015. I have not yet sent my application for renewal...

I know the most basic requirement for renewal is ..you need to be in Canada for at least 730 days. But they do not count the 1st month you landed and the last month your PR expires...
If I count my number of days from 02 May 2010 to June 2015 excluding the first n last month as per the rule....I have 715 days in canada.
Can someone please advice me...as at today....if I send my PR card for renewal....Will I be in trouble because I did not send it earlier....
N I would like to know, how do they count the number of days...will it be the day I send for renewal let say I send my application this year on May 1, 2016.

my second issue is my wife.... same as above... but the only thing is last year she travelled for 15 days outside Canada. So as at June 2015(date of PR expiry) she had 700 days.

I will be grateful to know when can she apply for renewal??

Thank you again

Apply after staying more than 730 days in Canada.

I don't know where you get that they don't count the first and last month. They count all days but only within a 5 year period immediately before you apply so if you apply today, March 5th 2016, they will count from March 6th 2011 until March 5th 2016 which is exactly 5 years. If you have 730 days or more in that period, you can apply. If you don't, you should wait. As you were outside Canada for more than 3 years, it is not possible for you to have a period of 5 years where you have 2 years in Canada and are still including time from before you left. Hence you will not have 730 days in Canada until you have spent 2 years straight after your 3+ year absence and this will happen on April 13th 2016, as long as you never left Canada during that time.

Exactly! Your first 328 days in Canada have now stale-dated and don't count towards your RO. Based on your post, you may send in your renewal April 9, 2017 (assuming you stay in Canada for the duration).
