My name is Nilab Shah Mahmood. I am a Canadian Citizen who lives in Edmonton, Ab with my husband, Ozar Abdul Maroof , daughter, Hena Abdul Maroof , and son, Shahir Abdul Maroof.

My daughter Hena is 9 years old. She was born premature at 33 weeks through C-section on March10,2008 due to poor growth in Burnaby, BC. She had to stay in NICU for 12 days before we could take her home. It was clear from beginning that my daughter had some medical issues, but we did not know the extent of her problems back then. As her poor health took us in and out of hospitals every day, we would get to see lots of doctors and specialists and every time, they would let us know of a new issue, a new sickness, a new concern for Hena. We were even told that she would not make it past 3-4 months of age. It was a roller coaster of sadness and hopelessness for us. In her young age, she has gone through several surgeries, including; G-tube, hips, ear drainage tubes, cataract extraction and tonsillectomy. She sees a lot of specialists and is dependent in all daily activities; she is on wheelchair. She has a long list of medical issues including;

• Global developmental delay, poor growth
• Seizure disorder
• Total dislocation of hips and other bone abnormalities
• Opitz Trigonocephaly Syndrome
• Gastroesophageal reflux
• Aspiration, G-tube fed( Compleat Pediatric 130 ml 4 times a day)
• Hypothyroidism
• Partial anomalous pulmonary venous return of right chamber of heart
• Frequent croups
• Poor vision, poor hearing, non-verbal
She has a long list of medications that she has to take throughout the day in order to survive.

Thank God my daughter is a strong fighter. She has won the battle for her life a few times after going into comma.

Throughout all of this, my husband and I have tried to stay strong, but it has taken its toll on us physically and mentally. We are under a lot of stress. I have chronic low back pain and depression. My husband has to work, so it is very hard for me to look after my daughter. I cannot even do my house chores because of my pain. Up until now, I could get some help from my sister Gita Shah Mahmood and my sister-in-law, MizhgonaAbdul Maroof. However, now, my sister is looking for a job and my sister-in-law is working and she is also going back to school in January. Therefore, I will have nobody to help me take care of my daughter.

I cannot entrust my daughter’s care to strangers after I had a bad experience with a care giver back when Hena was 4 years old. We used to live in Burnaby, BC. There was a care giver who would come and look after my daughter during the day. Back then, Hena used to have a JG-tube through which she was fed. One day, her JG-tube was mishandled by the care-giver and it came out of her intestine. When the JG-tube comes out, it should be inserted back by a specialist under x-ray or ultra-sound (I do not remember which). However, the caregiver inserted the tube back herself and did not let us know about this matter. Henastarted crying nonstop for 10 days and she would throw up every time we fed her. We would take her to doctors and they would say it was because of her acid reflux. We got to know the truth after an x-ray when the specialist told us that the tube had come out and somebody had inserted it back the wrong way.

With all that being said, I want my sister, Nabila Shah Mahmood who lives in Kabul, Afghanistan, to come here and help me care for my daughter.

My sister, Nabila is a healthy and strong 27 years old who is single. She is very good at taking care of my daughter Hena as I witnessed it last year when I visited Kabul between May2017-July2017. She was very kind and loving of Hena. She would spend a lot of time playing and talking to my daughter. I could see lots of good changes in Hena’s emotional and physical state. She would smile a lot, seek people’s interaction and attention by her hand and eye gestures. She would try to move more or make lots of sounds which happens very rarely. I cannot think of a better person to be with my Hena and help her in this hard journey that she faces daily. My daughter deserves love and proper care and I want to give it to her through my sister.

Therefore, I kindly ask for your help and assistance in allowing Nabila to come to Canada and be an emotional and physical help for me and my daughter.

Canada is a generous country. It has given life and hope to so many people in need. I am in desperate need of emotional and physical help right now. I hope my daughter Hena can count on Canadian government to help her have more love, affection and attention that her aunt Nabila can provide her.

First of all, wish the best to your daughter and your family. I have a daughter and a son, they are healthy, but they really drained almost all of our energy to take care of them, so I can imagine how difficult your family goes through and how much efforts you would devote to take care of your daughter.

But on the other hand, there isn't much you can do to sponsor your sister to immigrate here. It is unfortunate for you, but it is the Law of Canada. You can certainly try H&C ground, but it will be no guarantee to win.

This is a public web forum - not a government web site. So you won't get an official response here.

If your sisters wants to visit you in Canada, she will need to apply for a TRV. To be approved, she will need to demonstrate strong ties to her home country and prove she has no plans on remaining in Canada long term. You should avoid saying that she is coming here to help you. CIC will categories that as work and she is not allowed to work while visiting Canada.

H&C is only possible if her sister is physically in Canada.

Yes, you are right. So, the first step is to apply TRV for her sister to visit Canada. And unfortunately, unless her sister has a much stronger ties to her country, the chance is very slim.

Sounds like you need to seek the help of an immigration lawyer or consultant. They can probably better guide you as they are trained to handle cases like yours, especially if H & C grounds is involved.
