Good morning,

I need some help deciding the best method to apply for PR. I have been living and working in Quebec for the last 5 years on a work visa (I dont speak French). My work visa will expire at the end of this year. I married a Canadian citizen last year and we are expecting our first child in a few months :) I don't believe my work visa will be renewed thins time around.

As far as I can see it I have 3 options:
1. Apply for PR inbound and apply for an open work permit at the same time
2. Apply for PR outbound (from Australia) and not be able to work until I receive PR
3. Apply for PR as a Quebec skilled worker and ask for a derogation from the French language factor.

Would anyone have any suggestions as to the best method for me?

If i was to choose option 1, would I be OK to travel to Australia for a few weeks with my wife?

Thanks,

Simon

You should go with either options #1 or #2. I would apply outland since you are from Australia - the overall process will be significantly faster than applying inland. If you do in fact decide to apply inland, you really should not leave Canada until your have PR (leaving during the process will put your application in jeopardy).

My vote would be very strongly in favour of applying through the outland spousal sponsorship stream.

Thanks Scylla,

I just have a couple of follow up questions.

1. If i do apply outland I will need to change my status before my work visa expires to a tourist. My SIN and drivers license are related to my work visa. Would I be able to keep my drivers license? I am assuming I would lose my SIN.

2. I lived in the US for over 6 months in the last 10 years. I noticed the FBI police checks take 14-16 weeks to complete. Would I be able to submit my outland application while I am still waiting to receive the FBI results? I would prefer not waiting the 14-16 weeks before submitting my package.
