Hello People.

Hi Folks .

Im stressed...


My work Visa ( kitchen helper ) expired on april 12th 2010 with petro canada . I asked my immigration consultant to apply for a new LMO with Shell as a cashier but he refused cause he asked for more money . He also told me that I have 90 days ( july 12th ) to stay legally in canada even after my work visa has expired to apply for a new LMO with Shell . My LMO was recieved by my boss and sent to my immigration consultant in JUne 2010 . He has recieved the processing letter confirmation. My question is , 1 ) Am I illegal and he lied to me about the 90 days extension? 2) If I am legal and I get a refusal on my new work visa with shell , Am I able to apply for political asylum ( my family in the states have thier green cards they also filed for political asylum ) . I am sorry for this long post but I am really scared and I have nowhere to go. Please Help me!

Call the CIC call centre or go to Service Canada and talk to them. I believe that while you are in the process of extending work permit, you have implied status but not sure if it matters that you are changing from kitchen helper to cashier. If they say you are illegal, the 90 days is the time limit you have to restore your status to legal again.

Anybody can apply for refugee status but you should not do this unless you have a good case or you will be denied. I assume that when you applied for your work permit, you showed strong ties to your home country and intent to return there when your work permit expires. Did the situation in your home country change in the meantime or did you lie on your work permit application?

1. As soon as the OP's work permit expired, he was out of status. There is no 90 day grace period. The 90 day period is the time that he has to apply for restoration of his status. He had 90 days to 12/07/10 to apply for restoration ($200 and $150) for the work permit. See: http://www.cic.gc.ca/english/pdf/kits/guides/5553E.PDF See page 10

My new LMO for shell was sent in the month of june. I have just recieved a confirmation letter telling me that My frequest for a new work visa is being processed. My work visa expired on april 12th 2010. My new lmo was sent in june 2010. If i get a refusal on my new work permit, what are my options then?

New Update...The status restoration was done before the 90 days ( in june ) the LMO was recieved and sent in June also.

If your work permit is expired and you have already applied for an extension or new one with a LMO you will be considered on implied status which is legal.... As far as political asylum (Refugee in Canada) is concerned, I suggest not go with that. It is not good for longer run... You will loose your temporary resident status as soon as you apply for it and once you case will be refused your departure order will be issued and you can be deported and then you can never be returned to Canada..... Brother dont go with refugee claim

i am not sure how you can apply for political asylum...what country are you from??...are you from a country like zimbabwe, etc where there is political instability or persecution??...did u just think that if u apply for political asylum you will automatically get residency??.... do not mis·use the immigration system... they will find out if you are claiming asylum on false grounds and u will have no chance......
