Please help

My sponorship was approved and my wife in Kenya has her PRV application in 3 months ago. We have also put in for a TRV application 1 month ago and it was denied. Now we are submitting another TRV with a letter of support from MP and highlighting our daughter 2 yrs old is a canadian by bithrite born outside canada. We also highlite it is difficult for me to visit as I have to work, I am supporting them and i am here is canada a single parent to a nine year old.

After reading blogs I feel our lastest TRV will be turned down even with a letter from my MP.
What advise do you have?

Not much else to do indeed.. you can try to add in your application that your wife PR is in process, and that she doesn't want to jeopardize her application and will leave Canada at the end of the visa. It might help, but most of the times it's not enough.
Nairobi timeline on the website is really long, but a lot of cases get processed much faster, so I hope it will be the case for you.

Thanks for your wish that we may be one of the few lucky ones out of the niarobi office ;)

We did highlight the PRV application # and put a twist that it is our daughter (canadian by virtue) born outside the country of a canadian parent wishing to spend time with me her father. being only 2 of course her mother (my wife) would need to escort her her.

I am wondering if I ask my MP for another letter to support the PRV this might help speed things up. Yes I am not so hopeful on the TRV because they are totally dependent on me for support which has been the case since the start.
We lived togther over there but I had to return to Canada in 2010 to take care of my other daughter at that time due to neglect by her mother.

Oh my life is tough

The sad thing is i have had to use a lawyer all the way through 2 TRV and 1 PRV because I and my wife required it. I am overwhelmed working away and being single parent and my wife dosent understand many things to do in english so it is too hard for her. Swahili is native speech.

Hi Scott2539, it is overwhelming to work and single parent and do all of the administration. It is fairly unusual for people to get TRV's after marriage and with PRs in process and if you are paying a lawyer they should be able to advise you on the statistical success of this at your VO. It would be most important to demonstrate somehow that your wife will return and unless you add MUCH more proof from your last refusal, be prepared for another denial. If your lawyer is not being realistic with you, be careful as she/he gets their fee no matter what your outcome is. Buyer beware. Hope you have a support network throughout out this process, you will need it. Blessings.

Yes I am ok with another denial and at least i have something to hope for. No way to show the wife will return. Even when she was working it was not enough, like who can live on 150 usd per month?

They are living fine with my support and in 2 months I will play the push on the PRV with a letter from My MP.

I guess my support group is here at home, my daughter and brother, and this blog looking for advice from others who are going through the samething.

The lawyer and I made the choice together. Pros and cons, heck I hope we get a break and hit a VO having a good day in Nairobi.

When School is out and my daughter goes to visit her mom I will be able to visit wife in nairobi and see my baby who will be turning 3 years.

I have only seen her (my baby) twice>

it's hard indeed, but see it that way: each day that passes makes you one day closer to your wife getting PR... and then the separation is over. Nairobi has approved some files under 4 months, so it might happen to you... Good luck,

It is true one day and each day closer. When i was working/living over in E.Africa I thought it was all going to be so easy. I remember being in the line up to get into the embasy with infant and wife. We had no clue!
I noticed many people from E.Africa had a much better idea what was what and how to prepare. Well that was a lomg time ago and now I know and continue to learn more and more.
Our Government is making changes monthly (MP J Kenny) but it is those VO that have the power to change peoples lives. It is so easy to deny people TRV because it is setup that way. If by chance one VO feels too grant someone who doesnt have or meet the criteria on a sunny day, wow.
I mean lots of people have true honest stories but cant meet the requirements.

Hi Scott, every time I feel sorry for myself, missing my hubby, I think of all the folks going through this with young children, like yourself and I say an extra prayer. Do not want to even begin to imagine how hard that is, OUCH :(. Glad to know you have faith in your lawyer, that is really important and everything in life is a calculated risk , especially love! Hope springs eternal :) Best wishes for your family.

We share the thoughts and prayer. I see our application dates are very close too, as my wife's PRV went in at the end of Feb 2013.

My wife brought God back into my life and prayer is important.

Hi,
Just because your wife was denied the first time doesn't mean she'll get denied again!-I was in the same situation too years back going through Nairobi as well and was approved for a visa at my second attempt ;)-I also used my daughter as the reason for the travel so she could meet her dad!-So don't lose hope yet,have faith and everything will work out one way or another!-Is your wife Kenyan?which province do you live?

Hi Mrembo,

Wow you give me hope because you mention use of my daughter as main reason has worked in the past for you. sometimes lawyers can help. But I gave him first notice about my daughter being canadian by virtue of birthrite.

I did not mention earlier (my wife is Tanzanian) because it could be a long story. After our baby was born and I had to leave for Canada but before leaving we gave up our rental in Arusha and headed for Nairobi. I tried to get them here and even had tickets but in the end it was heart- break.
So since the main center for visas in all E.Africa is in Nairobi I keep them there. Plus I think she feels shame as all friends and such think she was to come to canada after marriage. But Nairobi has been good to keep up english skills and take english lessons. Her english is better then my swahili HEEEEheeee.

I am in B.C.

A permanent resident is a person who has been granted the right to reside permanently in the U.S. He/She is authorized to work and gains the right to become a U.S. citizen if he/she meets certain criteria.

The permanent resident is known as the sponsor of the immigrant visa petition while the spouse/child is known as the beneficiary.

A permanent resident who marries a non-U.S. citizen or permanent resident after getting his/her green card needs to file a Form I-130 (Petition for Alien Relative)[2] with the USCIS. Once the I-130 is approved, the beneficiary needs to wait for an F2A immigrant visa. The F2A immigrant visa is heavily backlogged because only around 90,000 visas are available each year and demand exceeds supply. The current processing delays for the I-130 can be viewed at the USCIS website.[3] The current backlog for F2A visas is updated each month. The date is available in the Visa Bulletin[4] posted on the State Department's web site.

While waiting for the I-130 to be approved or the F2A visa to become available, the beneficiary may visit the U.S. on B-2 visa (maximum 90 or 180 days stay) or under the Visa Waiver Program (VWP, maximum 90 days stay). However, in many cases, application for the B-2 visa or entry under the VWP is denied. Even once allowed a short-visit to the U.S., it cannot be repeated many times. Basically, the beneficiary cannot live or study in the U.S. until obtaining approval of an immigrant visa by a U.S. embassy or consulate outside of the U.S. This is because the visitor and student visas (or the VWP) require demonstration of non-immigrant intent. By definition, the spouse/child of a permanent resident cannot demonstrate non-immigrant intent.

The permanent resident, on the other hand, cannot be away from the U.S. for long periods. Doing so can be considered abandonment of permanent resident status.

This situation often separates the permanent resident from his/her spouse/child. These days, it takes 4-5 years[5] before family unity can be achieved.
