Hey guys,
I'll make this as short as possible. My study permit expired in October last year, 2015. I left Canada past the 90 day grace. I left on May 2016 because I had no money to fly out. I have now made a lot of money and can support myself for years without any worries. But I want to go back to Vancouver. I was there for over 4 years (arrived in May 2012) and it's my home. I have a Nigerian passport but I grew up in Dubai which is where I am now. What is the best way of going about this? Because I overstayed. Will it matter? Help me out please!

I still use my Scotiabank account and everything, not sure if that would help applying to immigration but I have a large proof of funds in there now.

What do you want to go back as? Student? Visitor?

You can't live in Canada as a visitor.

If you want to study in Canada again, then you would need to apply for a study permit.

If you want to come as a worker, then you need a full time job offer and approved LMIA.

If you want to immigrate and be able to live in Canada permanently, then you need to start reading here: http://www.cic.gc.ca/english/immigrate/apply.asp

Yes - it's possible your overstay may impact future study, visitor or work permit applications.

Thanks for your response. I want to go back to SFU in Vancouver, the university I was studying at. The Head of admissions asked for my passport copy. All pages including blanks. So I'm worried she might see when I was stamped entry into Dubai which is many months after the permit expired meaning she would know I overstayed, but it could be for another reason. I was just wondering how the overstay would impact my return? Any information would be much appreciated.

Yes - it's possible the overstay could impact your ability to get an approved study permit. Impossible to say for certain. You'll have to apply and see what happens.

Once you have been re-admitted to SFU, you will need to submit an application to CIC and apply for a study permit again. You need to make sure you are 100% honest about your stay in Canada in your study permit application. I would make sure that you include a letter explaining the reasons for your overstay since CIC may be concerned that you aren't a genuine student.

I wouldn't worry about the school refusing you because you overstayed. You need to be worried about CIC refusing the study permit because you overstayed.

Thank you. How would they notice I overstayed? Do they have previous records of my exiting the country? I feel like it wouldn't be best to bring up the issue in a letter when they might not consider it altogether. Then again that's a maybe. Normally I would explain to them that I had already been a student for over 2 - 3 years, show them he proof of funds, explain that I have lived in Canada, basically be transparent but leave out that detail just so I don't throw it in their face and cause it to become an issue that would've otherwise not been.

The question is, would it be a bigger risk to leave it out and they somehow find out, or just tell them even though they wouldn't have?

You absolutely need to say that you were in Canada until May 2016 in your study permit application. I believe you will also have to indicate your status in Canada and you will need to say that you were out of status in Canada from November 2015 to May 2016. Failure to be honest in your application is misrepresentation (lying in your application). Misrepresentation will result in a refusal of your application and may result in a five year ban from Canada. It's going to be very easy for CIC to find out if you lie. Don't do it.

You will have to bring up the overstay matter to CIC anyways. There is a plain question whether or not you have ever overstayed in any country you have visited.
For University, they have nothing to do with your overstay at all. It is completely a CIC concern, so I would suggest that the best you can do is to explain the reasons behind it sincerely and hope for the best.

Looks like you left Canada without completing any school. If that's true, your chances of approval are slim to none.

Maybe I missed it but another question that may arise might be what the OP was doing to support self from the time dropped out of course in 2015 through May 2016 hopefully not working illegally. Even working from the time dropping out of uni to the expiry of the study permit would have been illegal given would have no longer been enrolled in full time education making the overstay the least of the problems.

I guess I'll tell them then and hope for the best.

I completed years but then I couldn't afford the fees anymore because they were ridiculously high. Is that not fair enough? Also couldn't I leave Canada to go visit family as well without completing school? Would that then reduce chances? I can more than afford years of fees now, I could pay off my whole university tuition fees at once. Would that not help?

I didn't but do they look into each and every detail like that, especially for someone who's already been into the country for years prior?

Sure - you can expect they may look into that. They may wonder how you could afford to stay in Canada for all of those extra months without working illegally.
