I just got a call from immigration canada about custody status of my children...

Hi, I just received a call from seattle where my PR application is being processed. He was curious about the custody status of my children. My husband is sponsoring myself and two children. I split up with my children's father 3 years ago and he has been very cooperative with me moving to canada with them. He signed and notarized the required form requested by cic. My kids will be spending the school year with me and summers with their dad.

I am a little worried about this phone call. Is it normal to receive calls from whomever is processing the application? Do you think my application can be denied because of them not liking that I am moving my kids to canada even though their father signed the required form? Will they require me to obtain a court ordered custody agreement? It could be a non issue... The man I spoke to was very friendly and said everything looks great with my application. I was expecting other areas to be potential issues, not this.

Custody arrangements are not always court-ordered, and with a co-operative other parent, it is unlikely they will use this as a reason to deny your application.

You might want to cover yourselves, you and the kids' father, by having something agreed in writing between you and put on record, so it is clear the kids are in joint custody but you have physical custody in Canada with his knowledge and co-operation. This is especially a good idea if they plan to divide their time between you two.

I didn't think it should be an issue either. Thanks for the response. I was just feeling a bit thrown off and worried for receiving a personal phone call from the immigration officer. So far all correspondence has been done by email. It has only been four months since I turned in my application, so the fact that they are already reviewing it is good news. I agree, getting a notarized agreement would be a good idea.
