Hi, Wayne is right, your visa was based upon your employment and this has now ended you are currently here without status, unfortunately I'm guessing that your wife's visa is open dependant on yours being closed which also means she has lost hers too, regardless of her current employment. Technically she is not allowed to work as your visa has expired (due to circumstance rather than date). To rectify this you must find something as soon as possible as you are also not eligible for ER.

I know, it sucks and I apologise. I only know because I went through the same thing a year and half ago. Your status will now be a visitor of which you have to be finacially independant (ie not able to work). You do need to let CIC know that your staus has changed although you can legally remain, just not work. This will probavly not affect your application if you can find something as soon as possible (with the same NOC code) - I managed to find something within 2 weeks of finishing, updated by temp visa, my family's visa was updated in line with my new one and we carried on as normal - we got confirmation of our PR today so it can work if everything stacks your way!! Again, Wayne is right with regards to the points, you have applied through FSW which is also dependant upon current employment offer as well as work history so there are now elements of your application that don't check out. Hopefully if you can find something quickly then you will be able to update them with new information and visa and that gap will be bridged.

I applied under the AOE FSW(worked for 13 months and got laid off)
I scored 87 points with regards to the point system. With the job lost they will -10 points at the VO which will leave me at 77 still higher then the pass mark of 67 points
My Wife is currently employed and earning a larger Salary then I was on an open WP. Her employer is not able to sponser her due to his fear of lossing her also she is working as a Chef in a restaurant but she is qualified as an accountant. So putting her on the Close WP might be a problem, unless there is away around this.She has never been to culinary school however she has the skills.

Since we are still higher then the pass mark would this aid in our plight of getting the PR. Would I be able to make a strong enough case to getting the PR.

Our file is in the RBVO state at Buffalo.

I am also in similar situation, but after researching, talking to lawyers and CIC Callc enter I wish to provide my insight to out situation.

1) We are in valid status so we need not to worry about our stay till expiry of our work permit. so for ex if we have work permit till 2015 we can stay in Canada till 2015 with condition to work for specific employer for particular Job title under NOC code LMO was approved

2) Technically there are two different ways you can see your employment or Lay off situation, First you can actually tell IO at visa office (after consulting your employer) that you are taking a voluntary break from employment for 4-5 months to solve personal issues at home. Secondly you can actually negotiate it with your employer and ask him to issue a letter of discontinuation of job for limited period with scope of reporting back at a later date after reconsideration.
