I have a job in Canada — do I still need a LMIA?

Hi,

I am on an open work permit and have a job in Canada. I have been employed by this company for four months (but held a similar position at another company for eleven months).

I am about to apply for CEC.

Should I ask my current employer for a LMIA? I understand that it will give me 50 extra points that would bring my total up to 170+. Can I apply without a LMIA if they say no?

My work permit expires in February 2020 and it's my understanding that if I haven't got an ITA by then, I will need to leave my job and return to England — which I really don't want to happen!

Any help appreciated!

if you have an open work permit then your employer doesn't need LMIA.
You do if you want to claim the extra CRS points, unless you have been working for the employer for over a year AND the employer is named on the Open Work Permit.

I will ask them to apply for a LMIA as I would like the extra 50 points.

Can they obtain a LMIA if I am already working for them?
