I got legally married this year in India but want to apply as a single applaican

I got married this year legally in Mumbai, India for the immigration purpose however it has not been mentioned in any document. Another thing which I have to mention is that I am Muslim so until and unless I cannot get my nikah I cannot even consider this as a marriage.
However now me and my legal spouse are having a break up and as per Indian Law you cannot get divorced within a year. So I would like to know if you can apply as a single applicant and will their be any possibility of cic to find this as there are no records in professional docs neither in personal nor in passport.

Another option I can think of is I can re-marry to some other girl get my Nikah done with proper legal marriage, then do I have to show my previous marriage records ( As I am still waiting to send my EOI)

Experts please advice.

So, you intend to lie about your "legally" married status to IRCC? If you are "legally married" in India, such that you require a divorce, assume that IRCC can, and will, discover this. I should also point out that when they do, it's an almost automatic ban for 5 years for misrepresentation.

I dont think they can. But as zardoz mentioned its risk. So if thats the risk you have to take then think twice and take it and see if you get through.

Another option is that you can still specify and include the spouse as non-accompanying and when it comes to medical stage write a notarized letter on non-cooperating for medical from spouse side. Some have gotten through this non-cooperating spouse/child at medical stage.

I think that you can try to get some legal advice to get it executed neatly rather than trying alone while things are complicated as we get chance in life once or twice not many times and we dont want to again messs it up in hurry.

IRCC will require legal separation or legal divorce. You will have to be able to supply supporting documents.

If you have properly registered your marriage with local govt institution like marriage registrar etc and have received marriage certificate, it means your marriage is legal. I am not sure if not doing proper nikah has to do something with your legal marriage.

Also, don't misrepresent yourself, it may affect you in future. If CIC does not know this right now, they might know in future and then you will be in trouble. Tell the truth that you are married. You need to get good legal advise with a good lawyer to check how to file the paperwork properly (regarding your marriage breakup and your spouse not accompanying with you)
