Hi,

I am Malaysian married to Canadian and now we have two toddlers living in Kuala Lumpur, Malaysia. Both kids are Canadian Citizen with valid Citizenship Card and Malaysian passport. We are planning to move to Canada next year.

I need to apply for PR. Not sure of the procedure, can someone advise me how do I apply for the PR? I'm assuming my kids do not need to apply, am I right? ....and what if I want to bring my mother along? Where do I submit the application and what sort of fee/s do I need to pay and how long will it take?

Your spouse needs to sponsor you for permanent residence. The forms you need and instructions are all here:

As citizens, your kids do not need to be sponsored (however they must still be listed on IMM5406).

Your total fees will be $1040, and it's best if you pay it all together up front.

It will take about 2 months for the sponsorship part of the application to be processed in Canada (CPC Mississauga) then 2-10 months for the PR part of the application to be processed in KL. If you submit everything asked for up front (all the fees, police certificates, correctly completed forms, and plenty of proof you have a genuine continuing marriage, that will help keep the processing time in KL down.)

Matt, thanks for the reply. The fee $1040 is in Canadian Dollars or Malaysian Ringgit, how or where do I make the payment? Where can I find the fee schedule/detailed breakdown will make me understand better.

What if I apply from here and move to Canada before it arrive, what should I do? Or can I apply for PR when I am in Canada? What sort of document I need to apply to stay in Canada and how long before PR application?

...and what about my mother, what's her process?

Read through all of the sponsor's guide, and applicant's guide carefully - most of your questions will be answered in there.

As for your mother, there's no way to bring her to Canada at the same time, with you. You have to sponsor her for Permanent Residence, but you can't begin that process until you yourself are a permanent resident living in Canada, with a sufficient income to sponsor her. (Your own application as a spouse doesn't require the sponsor - your husband - to have a minimum-income, but when you sponsor her there is an income requirement.) Parental sponsorships are one of the slowest processes and it will take a number of years. Step 1 is becoming a PR yourself, so there's not really much point worrying about that process until you are a PR. If you want to read about the process the application package is here:

Moving to Canada before your PR visa is issued will be difficult as you need a visitor visa to visit Canada. They are unlikely to issue a visitor visa, because your intention is to move to Canada permanently. My advice would be to get the PR application in soon, and move after they issue the PR visa.

The breakdown is:-
1. $75 Sponsor, per application
2. $475 Principal applicant who is 22 years of age or older, or who is a spouse, common-law partner or conjugal partner, regardless of his or her age. Number of persons: 0 or 1.
3. $490 Right of Permanent Residence Fee*
Principal applicant or accompanying family member who is not
a. a dependent child of the sponsor or principal applicant,
b. a child to be adopted by the sponsor, or
c. an orphaned brother, sister, nephew, niece or grandchild of the sponsor.

Do I need to purchase medical coverage for my family or will we be covered by Govt.? Where can I find this information? Eventhough my husband is Canadian, he is not sure and been outside Canada quite a long time. I will appreciate if you can direct me to proper link etc. This is very important to know.

The exact rules vary, but most provinces require a 2-3 month wait period after you arrive for newly arriving PRs and citizens who have been out of Canada for a prolonged time. During this wait period you would need private insurance for all of you (including your husband and children).

Once they have approved the application, they issue you a PR visa you can use to travel to Canada and become a PR. You don't actually technically become a PR until you arrive in Canada. Normally, the PR visa is valid until the expiry of your medical results (1 year exactly after the day you do the medical exam) or the expiry of your passport, if earlier.

So, if you do your medical exam, submit all of the application forms to CPC-Mississauga 2 weeks later, processing in Canada takes 2 months and processing in KL takes 4 months, then your PR visa would be issued with 5.5 months of validity.

That means you have to travel to Canada and become a PR within that time. If you don't land in Canada within that time, it's not that they revoke anything, it's just that you'd never actually become a PR, even though your were approved to do so.

Once you are a PR in Canada you have to maintain your residency, by living in Canada 2 years out of every 5. (There's an exception that means living together with your Canadian citizen husband outside Canada counts, if you decide to live abroad again.) The residency obligation is described in detail here:

1. You can, but you would be there as a visitor and would not have health coverage. The processing time for inland applications is a lot longer than outland.

2. No, but once you become a PR you can. It takes a REALLY long time. If you look at the processing times , they are currently working on applications received between September 2007 and November 2009. So you are looking at AT LEAST 31-55 months when they start accepting applications again, which will be in about a year. (more information can be found here: cic.gc.ca/english/immigrate/sponsor/relatives.asp). You can, however, apply for the parents/grandparents super visa (cic.gc.ca/english/visit/supervisa.asp).

3. Fees and payment method for what? For your parents? You can find all fees here: cic.gc.ca/english/information/fees/fees.asp

4. I don't understand the question? You will need a valid passport from your home country to travel to Canada.

5. They are all pretty painful but outland applications are the fastest way to apply for PR (that means applying from your home country). You are looking at 2 months for your sponsor to be approved, and anywhere between 2-24 months for you to be approved. All of this information can be found on the CIC website (cic.gc.ca/english/information/times/perm-fc.asp).

I was just looking at the CIC website and you they are no longer taking applications for parents and grandparents as of Nov 2011 for at least 24 months. You are going to have to apply for the super visa.

Hi Crassy,

Thanks for replying. I need to clarify the following:-

Question no. 1 - health coverage. I can buy a medical coverage from private insurance in canada?

Question no. 2 - super pass visa. Am eligible to apply for my mom without becoming a PR first?

As for question no. 4.... i meant if i want to apply for multiple entry visa. however, i got this part sorted out.
We are intending to enroll our daughter for her 1st grade next year. Waiting for 23 months (outside cananda) is too long. i've checked the website it stated inland application is 8 months, it that correct?
