I am a Canadian, my Spouse has OWP to expire, no response from EE or OWP.

I am a Canadian citizen and my husband has been living in Canada since 2010. He came to Canada as a Post Graduate student .We have been married and living together for 2 years and he has been working in Canada on an OWP for 3 years. He has applied through the Express Entry option as the processing time was less than if I sponsored him as a citizen and he also qualified under that option.

There has been no invite to apply for PR as of today, June 12th. His OWP is about to expire on July 25th, he has already sent the EE application since April and have had no response. He has also sent the application for extension of the OWP since April. The processing time on CIC website shows they are now working on March's application for work permits.

We are now in a very difficult position and facing the worst possible scenario that my husband will have to leave his job and Canada. We have done all possible for my husband to continue to be in Canada, work and stay with his family. Are there any other options that we are not aware of that we can try in order to avoid my family being separated? The BWP would not work if he did not have an invite to apply for PR.

My husband is a productive individual in Canada that pays his taxes, abides by the law and contributes to society. I find it hard to believe there are no other options for my family.

Please help!

sorry to hear ur story but its same story for many of us here . EE system works on points based system. Earlier CEC option once u applied it was sure shot way to get PR in most cases but with EE canada selects who they want. its a very frustrating change for us who came to canada to study and then found jobs and earn here which also we spend here in canada. we are all in the same boat waiting . what is ur husbands CRS?

yes you do have a option.You can apply for Open work permit. Read on cic site about their inland spouse OWP.

Can we apply for the Inland OWP for my spouse even though we already sent in the application to extend his current OWP? What are the processing times like if we send this application in?

Is this for those who have already submitted an application for permanent residence? Right now only the Express entry application has been submitted and there has been no response to apply for PR online for him.

My husband is Canadian, and I too thought it would be a faster timeline if I applied under EE compared to inland spouse,

BUT, before I applied to EE we submitted an inland spouse application WITH an OWP application, in that case, if the OWP application is submitted in the same envelope as the inland spouse PR application, the processing time is 4 months. If you do submit a PR application before the work permit expires you are on implied status and you don't have to leave the country, and in some cases (I'm not sure what cases though) you may even continue working for the same employer.

Can the Inland OWP be sent after the above has been done without the invitation to apply for PR?

Or now it's just to wait until can apply for PR through the Express entry and only then can apply for the Bridging Work permit?

The OWP extension you have submitted is going to be refused since your husband doesn't qualify for it.

You can apply for an OWP along with an inland spousal sponsorship application. It will take around 4 months for the OWP to be issued from the time the inland spousal sponsorship application is submitted.

Applying for EE doesn't preclude you from applying for the spousal PR,
EE is not guaranteed and you never know when one might get an ITA (without the 600 points for PNP or LMIA),
if you submit the application to a spouse PR and an OWP together, you get the OWP in 4 months, and if meanwhile you got an ITA, even better, you got the fastest of the 2 tracks.
