Hi Guys!

I've searched for this situation and have not found it... Please forgive me if it has been mentioned before, but I'm having a hard time efficiently using the search function in the forum... There are thousands mentions of rejection, but not one after a PN...

I'm wondering something... Let's say I have CRS of 440 and have just received a nomination via OINP (not real - hypothetical situation), then I'd have a CRS of 1040 and very probably would get the ITA in the next draw... So far so good!

Now let's say I accept the ITA and mess up my eAPR but doing something stupid like forgetting to include a document (say my Degree certificate) and they reject my eAPR because of this silly mistake.

So now I'd be placed back into the EE pool and would have to wait for another ITA, right? My question is, would I still have the OINP nomination and have a CRS score of 1040 or would I be placed back without the nomination with my original CRS score of 440?

If you are rejected at eAPR stage, you profile is scrapped. You don't get back to the pool.

You will need to create a new profile, contact PNP office and reset the nomination with the new profile. (Assuming PN is still valid)

Hmm... that stinks then! I guess if it comes to that then the best option is to appeal. It's just that everywhere I look seems to suggest that appealing is a waste of time, you're much better off just redoing the process...

Wonder if he OINP PN would still be valid if this happens... my thought is that it wouldn't because on the form it specifically asks if you've already applied for PR and have been rejected, initially you'd answer no, but after this happens would have to answer yes... Has anyone actually seen this happen (or, God forbid, experienced it)?

If you make an error (e.g. forget a mandatory document) - then there most likely won't be anything to appeal. Appeals are for situations where CIC has made a mistake - not for situations where you were the one who made the mistake.

You make a valid point... But seems unfair to penalize a candidate that has already gone through a potentially painful PNP process (and for OINP paid an admin fee of $1500) for a silly mistake, so in this case it seems it will boil down to case officer who is reviewing the application, if he's having a bad day then you're done, if not then you may get lucky...

PNC explicitly said nomination does not guarantee residency.

It's perfectly fair for IRCC to reject an application due to insufficient proof. IRCC can't reject an application without evidence. There are internal guidelines for granting PR. Of course if you find you have been treated unfairly, you can talk to your local MP and appeal.

And you can call the PNP office to reissue the PNC electronically to a new file.

Yes, I'm well aware of that. CIC will do more extensive background checks with PCC and travel history where as the provinces only really assess the candidate's potential economic impact.

My question is more to do with a rejection due to stupid mistakes and not because they (CIC) have discovered something serious, such as a hidden criminal record, that warrants rejection (and possibly banning). On the EE rejection thread you hear all sorts of stuff, from guys getting rejected because they forgot to upload their degree (having uploaded their ECA) to people who purposely tried covering gaps with false information...

You said to call the PNP office and get them to transfer the nomination, that seems simple enough, but perhaps too simple... I'm now wondering if anyone specifically with a OINP nomination has managed to get the nomination transferred to a new profile because of a rejection post ITA? If so, how simple or painful was it to do this? Was it simple like call them up and did you have to go through part of (or the whole) process again?

Stupid mistake is your mistake. By signing the page upon submission, you have legally signed and declared you have completed the application to the best of knowledge available. [1] You can't blame anyone.

I am not sure about EE electronic PNC. But in paper PNC, I just include the same letter from PN office and resubmit the file. Ref numbers and every details are the same.

[1] this means not only your own knowledge, but all knowledge available to you. You can't blame CIC because you didn't read the instructions thoroughly. If the rejected you for mistakes you can't possibly know (perhaps involving internal guidelines), then maybe you have a case.

Yes, that's exactly what I'd like to know! I should imagine that paper PN is just a matter of submitting another copy of the PN, but the EE electronic version is tied to the profile... So how easy/painful is it to get them to re-issue or transfer it across to a new profile?

I'll just stick to your - just call the PNP Office and see what they can do - option for now... who knows, it may be as simple as that! ;D

Hi If you look on the express entry threads you will find many instances where persons are rejected for errors and all they do is email the province with their new EE profile and rejection letter and ask to transfer the nomination. Persons report this being done as early as 3 days and some as long as 3 weeks. Hopes this helps.

Excellent! Thanks MASF, that's what I wanted to know... I've briefly search the thread and did not find anything relating transferring the PN to another EE profile, I'll do a more thorough search now! Thanks a lot!
