Husband is being relocated to Canada, but I have a DUI .... HELP PLEASE!

Hello & Thank you in advance for helping!

My husband has been working for an American subsidiary of a Canadian company for the last 6 years. The U.S. division is wantting to transfer him to Canada. But I have a DUI from 2009 (first offense) but my obligations from this offense did not end until 2011. I am terrified that we will not be able to go. From the information I have read on the CIC site, it appeasrs that the only way I can even visit would be to apply for a temporary resident permit. >>> I know temporary resident permits cover "extenuating circumstances" .... But I am soooo scared and nervous about this one & I can't talk to anyone at a consulate as they do not accept calls & the nearest consulate that is open to the public is 18 hours away :eek:

My questions are

1. Has anyone ever had this happen, or heard of this happening, & what the outcome was?

2. I am unsure if my husband has to apply as well in order for me to apply for a TRP, If I need a passport also to apply? Just unclear as to what all applications I need to submit in order to make sure I have everything I need. The CIC site has a checklist, but I am just unsure if my husband has to submit an application & if so which ones and supporting documents. I was totalling up the applications I "think" we need and it totalled C$1,850.00 I am so nervous to spend that and not have a complete application or if if is "hopeless"

Unfortunately it looks like you are inadmissible until 2016. I do believe a TRP is your only option. However TRPs are only issued for exceptional circumstances (e.g. visiting a terminally ill relative in Canada). I'm not sure your situation qualifies as "exceptional". Forget about visiting a consulate. You need to consult a Canadian immigration lawyer asap.

And yes - you'll need a passport.

Have you checked your FBI Certificate? does it show there?. Were you actually detained

Thank you both so much. I was afraid of this. Feel as horrible now as I did when I committed the offense. I will definately be touching base with a Canadian Immigration Attorney first thing tomorrow. I have not checked my FBI certificate. Can you do this for your own "personal" purposes? ... I was detained overnight (pulled over/car towed) and then released on bond. I was not sentenced to any jail time, but given probation, had my license suspended, ordered to pay fines, completed an alcohol treatment program, driving course. But I did plead guilty, admitted to the officer that I had been drinking, as I was 100% guilty.

Yes - you can certainly request an FBI certificate for your own personal purposes. Information on requesting one is below (note that it takes 16-18 weeks):

Just make sure you speak with an immigration lawyer as soon as you can. I think that's the most important thing you need to do to find out if you have any chance of being admitted before 2016. Good luck.

Check FBI, and if its clear then the lawyer will give u the answer

Check with FBI and then proceed with applying for your passports.. You can even try for an DUI expunge in your country court with the help of an DUI attorney's
