Cant Canadian embassy consider the H & C ground for the best interest of a Child as in my case. Because my daughter is a child of 12 years & for her best future cant Canada embassy issue/consider the PR TD to us?

No, if they did, basically any PR who has a child would have a free pass on the residency requirements. Immigration will say that you had no problem raising your child in India until this time so there should be no problem to continue. If you have family or friends in Canada who are willing to take your child and let her live with them and go to school in Canada, you can try applying for her TD now as a removed minor but immigration is not going to give you a free ride on not meeting the RO just because you are a parent.
