Hi,
I am considering applying for H&C as my refugee claim was denied last year after which I appealed and was rejected as well. I’m currently living in Canada , I have a work permit and currently have admission into a top Canadian university. I recently had a job and I was an international student prior to applying for refugee status. So my question is: should I apply for H&C or just renew my study permit. And also does any of this affect my work permit standing considering that I just lost my refugee claim appeal.

What would you advise me to do in this situation? Should I go ahead and apply for H&C or just continue working and then apply for my study permit and go back to school?
Thanks!

I believe you'll be ordered to leave Canada now that your appeal has been refused.

I believe you can try the H&C route. Refusal rates are low with this stream.

H&C won’t necessarily prevent you from being removed either. And I’m not sure, but I believe with a failed appeal, you are ineligible to apply for H&C for one year from the date of the appeal decision. You should follow up with an immigration lawyer for your options now. I would also expect a study visa application to be refused given you refugee claim.
