Hello,
has anyone applied on Humanitarian and Compassionate (H&C) grounds on the forum?
Is there any good chance to win?

My stepsister was in jail in Japan and could not take care of her daughter (my niece) back home in Indonesia.

My mother (citizen) and my stepdad (born-canadian), brought my niece to Canada under visitor visa,
Applied under Humanitarian case for PR and was approved within 1 year. She is now a PR.

Immigration had to confirm that her mother was in fact in Japanese jail, they sent correspondence with Japan, etc. to confirm.

Yes, if they are out of status, they will be reported and receive a removal order.

It depends on how long the person was admitted to Canada, for example they were admitted for 6 months, make an H.& C application (which takes 6/7 months) and don't apply for an extension or are refused an extension, they are out of status after the 6 months, and reportable.

thank you for your reply PMM. on all immigration lawyers sites they say that H.& C application takes upto 3 years to be finalized. cic site says 6-7. whome to believe? will Vegreville send the application to the applicant's local visa office?
unfortunately there's no much information about it on the cic site and lawyer keep people confused. please do help with understanding.

just one more question - is it really a must for an applicant to stay in Canada during all the process? can this person have a short trip to the US and back?

My husband and I just broke up. I have lived in Quebec for 8 months now. My visa is Visitor which lasts until 2019. We applied for sponsorship inland; the step is on filling Background form, police check, and CSQ. We just got police check last week.

So my question is after we withdraw sponsorship application, will I have a chance to live in Quebec or Canada? I actually prefer to live in somewhere else, not Quebec as I don't speak French, but it is ok if I only can live in Quebec for a few years before I can move to another province.

Any advice will be appreciated indeed!

As of now, you're only in Canada as a visitor and can't "live" here (especially after the sponsorship application is withdrawn). Your visitor visa is valid until 2019 - but this doesn't mean you can stay until then. When was your inland application submitted (how long ago)? Did you include an OWP application with the inland sponsorship application? It's possible you may find yourself in Canada without status once the inland application is withdrawn.

OK - that's good you applied to extend your visitor status. That gives you valid status in Canada even if the application is withdrawn.
