I got the AIP approval in 27/6/2019.
They told me that my file had been transferred to the Niagara office.
Before the AIP I was asked for medical examination, file security, and payment of residence fees, in 12/4/2019
" Questions "
1- Will medical examination, security file and fees be requested again?
2- How often does it take the second approval time for H&C?
3- Is the Niagara office a quick office?

However, the threshold for approval is high and the success rate is low. Just because a parent is an aged widow, it does not make them eligible. If refused, the chances of ever being granted another visitor visa will be much reduced.

Canada has various programs for parents to visit like supervisa and PGP. Have you even tried to apply for PGP? It seems like you have only been in Canada since 2016. If your mother is denied she will have difficulty visiting ever again. If your mother is in her 50s or 60s she is usually able to care for herself, if she was widowed when you moved to Canada you knew she was going to be left alone and you made a person decision and if she has any form of family nearby that will also be an argument against H&C.

My income doesn't qualify under supervise & PGP, however my mother is currently on visitor visa wherein, she is allowed to stay for 6 months, she has been granted 7 years visitor visa as per validity of her passport, however, when I migrated to Canada, she was normal, able to manage by herself but now she is losing her memory, has diabetes, isn't able to take care of herself, so though of applying under H&C

How old is she? If you don’t meet the LICO amount how will you be able to afford the cost of another person and their healthcare costs? H&C usually takes many years to get an answer.

My mother is 68 years, as a single mother I have managed handling my 2 dependents expenses without going on social assistance, then of course I can manage my mother's expense too. I don't mind H&C application taking years to give me their decision, I need assistance for framing me the wordings for filling out form IMM5283 from Line 7-13

Why would you even mention going on social assistance ? You knew back in 2016 when you got nominated for the MPNP that you were coming over alone as a single mother etc, and now it’s a issue where you want to circumvent the programs in place

“I m from Mumbai, & have been nominated under MPNP prgram by Manitoba, I have already send my PR docs to CIC & awaiting reply. Living without welfare is not an accomplishment. It is a basic societal expectation of everyone.

If you don't even make $40000 and she has such medical issues, how do you expect to support her for the several years without health coverage?

You moved to Canada 3 years ago as a single mother so I don’t see how your situation has changed and now requires a H&C consideration. Hopefully you have taken out medical insurance because one trip to the hospital will be unaffordable. Even a regular visit and prescription may put your budget at risk. How are you going to pay for her diabetes medication and testing supplies? Those will be out of pocket expenses.

I make 40K but have just got this job 3 months ago, & yes I am holding a valid medical insurance coverage for my mother during her stay in canada

3) My one sister was there in my back home when my parents were in back home before coming to Canada.
4) But now my sister died and my parents are alone in back home when parents go back to back home from Canada because they come on visitor visa so they have to go back to back home after 6 months.
5) But it is very difficult for them now to live there alone because there is no one there in back home with them.
6) This is their 3rd visit while they are here in Canada.
7) I am on PR here but my all other siblings are citizen here in Canada.
Now I want to apply for humanitarian visa for them.

Can any one please guide me, step by step, what to do in this regards please?

Hi - you'll want a lawyer so that you can fully understand the risks associated with an H&C application, for example - what happens if/when it fails, how to maintain status and avoid the start of any enforcement action, and what sort of considerations the decision-maker will entertain, such as their co-dependency should they be required to leave Canada.

You have hurdles to overcome and maybe someone here will go into detail about what they may be (for free) but I won't and that's why I suggest counsel because free advice is often expensive with regard to the results of that advice.

Good luck and if it all goes south and they can never get a TRV again, that will be on you.

The PGP program is exactly for this situation. H&C is not guaranteed for parents. I have attached an example where even a single parent was not guaranteed. As others have already mentioned there is a risk when you apply for H&C. If denied a TRV or supervisa will be very difficult to get because it will be clear that they want to remain in Canada. Why haven’t you applied for a supervisa so they can remain for 2 years? Are your parents healthy enough to do the basics like care for themselves? They have each other so would not be considered alone in their home country.
