Huge Dilemma after attending interview

My spouse (the applicant) attended an interview in her home country. Before this interview she has been in canada for quite a few years and we have been living together for roughly 2 years. We have provided proof of cohabitation (joint bank account statement with our address), Ontario Drivers license with same address, etc.

One of the question raised during the interview was why my spouse isnt pregnant yet. My spouse was very honest and advise that we purchased 2 houses this year. (1 of which we live in as a matrimonial home, the other 1 being a investment property) The interviewer counter-questioned her and asked for proof of ownership of two homes and asked for us to provide this within 2-4 weeks and threatened her that the application could be rejected if we dont. I find it outrageous that they demand for "proof of ownership" but I feel that we have already satisfied the criteria for proof of COHABITATION but the interviewer went a step further to demand more. We have many many pictures together and proof of the address.

I, myself is very engaged with canadian real estate (every year ive made transactions, either buying or selling). As a young investor we have not made plans together to settle down in one house and always plan to move around for financial gain whenever there is an opportunity in the market. This is the nature of the real estate market now in Canada. Our first home we lived in, I purchased with only my name on it and at that time I was not married with her but she lived in it the entire duration. We sold this home this year (it obviously only had my name) and we purchased a larger property (which we live in together this year). Due to mortgage complications and my stronger financial profile, the mortgage only has my name on it for the larger property. The real estate lawyer can only register my name as the owner to match the mortgage. But this is a matrimonial home. Therefore the officer asked for a proof of ownership that we dont have. THey advised that most married couples own a home together in both names. I dont understand this logic because my spouse is not a PR in canada yet, this can really complicate real estate transactions if she is out of the country and as a active real estate investor, I make quick moves when opportunity arises. The same applies for our "2nd home" which is a rental property. I am the only registered owner and landlord due to the nature of the mortgage application. If her name was on it as well then it really complicates/delays the mortgage application and could disqualify me for that mortgage and also to mention that most rental properties have no reason to have joint owners

What can I do in this case? I really doubt that these outland officers understand the canadian real estate moves that I have made here. One of the officers is from Singapore I believe. Im not sure they understand the concept of ownership title on the house has to match the mortgage names and due to complications I did not include her name on the mortgages. I am not sure if they understand the concept of matrimonial home as well. also to note, we have a joint bank account and all mortgage payments are made from there.

Please help as we are threatened a rejection for something silly :-[ Is there anything I can obtain from my real estate lawyer to make this officer happy

Is it going to be difficult to provide the deeds to the properties, and the same explanation that one is a rental to the visa Officer? They want to validate the story. What's wrong with that?

Hi, like I mentioned before... her name is not on the deed or title. Due to her not on the mortgage (to make things simpler on mortgage qualification and processing) But 1 of them is a matrimonial that she has been living in. one of them is a rental which is only my name as a registered owner

And, is your name on it? If so, explain that she wouldn't qualify for the mortgage. I don't see the concern here. They want to validate the story is all I see...

Hi,

Joint ownership of the properties does carry significant bonding between husband and wife but your situation obviously didn't allow to do that. I think the way you explained here does make sense. A well drafted letter of explanation will satisfy the VO. Send them proof of your present ownership as well as your future possible plan to include your wife's name in your next investment.

Explain the situation in a letter - be brief and clear - about why just your name is on title for both homes. I would then also include a letter from your real estate lawyer explaining the law in Canada about the matrimonial home - that is, that whether or not your wife's name is on the title, since it is the matrimonial home she essentially owns half of it.

I hope that the visa officer just wanted proof that you did in fact buy two houses, and are living in one together and using the other as an investment property. As opposed to being suspicious that because your wife's name is not on the title, this somehow impacts the genuineness of your relationship. I would go with the former, and just send the proof of ownership, and the letters of explanation.

Thanks I will do just that. Is it normal after interviews for the officer to ask for additional documentation that were not initially mandatory? THey also asked to send via email.

ALso one more question, have there been any cases where they ask for a 2nd interview? Can my spouse safely come back to canada as a visitor for now without being asked to go back to home country again for something....? :eek:

It is not really common for the visa officer to ask for more documents, but they can. A second interview is also possible, but it is unlikely.

They advised us to email them the documents. We have not heard back or have no way of knowing that they received them and what are the next steps...
