Hello, One of my friends got his PR in 2012. He stayed in Toronto for a few months and had left to his home country. He came again in 2016 but he is sure he cannot meet the residency obligations before his PR expires. All these years he has submitted his and his wife's nil returns and got some amount credited to his account as HST credit. It is only credited for him and though he submitted his wife's nil returns, nothing given to her since she never worked in Canada. Will he have to pay back the credited HST when he no longer continues to be PR in 2018? Please clarify.

Yeah, he will get letter from CRA for the audit of residency, then if he failed to prove his residencey in canada, he will get letter to refund his HST or any other credits etc

He committed tax fraud. He needs to inform CRA of when he left Canada and pay back the money he didn't qualify for before CRA catches him and charges interest and penalties.

If he is in Canada and remains here for 2 straight years without leaving, he will once again be in compliance with the Residency Obligation.
