HRSDC opinion - how determinant it is

Hi All,

I am a bit concerned with a response given by HRSDC about the correct NOC code of my duties. Well, I sent them an email regarding my former job as an administrative assistant in an accounting firm. This is a list of my main duties and responsibilities:

- Assisted in the tax return preparation and regulatory filing process;
• Formatted memos/letters according to the Canadian Tax Foundation Style Guide;
• Processed, reconciled invoices and created expense reports through PCS software;
• Managed a high volume of confidential paperwork including bank information, tax slips and electronic documentation;
• Compiled client data related to the tax preparation process;
• Participated in special tax projects, as required;
• Assisted in the training of new administrative staff; and
• Was being mentored in Canadian and US tax compliance.

I already filed for PR a week ago and classified the job done under 1241 code (administrative assistant). HRSDC asked me what was the level of education for this occupation and I replied that it was not specified as I was a temp working through an employment agency. This was my last assignment where I was working for 10 months/40 hrs per week. According to them, this is the NOC that may fit those duties:

Of course they also said that "You are in a better position to determine whether or not this NOC code reflects your job."

So... right now I don't know... I feel a bit frustrated. I reviewed the above link and think that most of my duties are more likely to fall under the ones that admin assistants do.

How determinant is HRSDC response? Is it only an opinion and at the end the VO will decide based on his/her best knowledge? Would appreciate any thoughts.

Hi aliennotanymore,

You have to understand that HRSDC will not say that such and such is definitely your NOC code. They will only give you a probability because they are only assessing you based on the information you have provided. They do not want to be liable for any misinformation by you or any different interpretation by CIC. Even though they are government agencies but they are 2 different agencies. One cannot make decision for the other.

Take your workplace, for example, even though all departments are working towards the same goal, 1 department cannot decide what the other department's requirements are, even if the requirements overlap.

So, the letter from HRSDC does add value to the application but always remember that the VO's decision is (almost) final. I say almost because, VO's are humans too and can make a mistake. The letter from HRSDC confirms to the VO that you have taken some steps to identify your NOC.

Another way of identifying a NOC is asking your company to put it on the reference letter. Every company will know what NOC the post falls under and if they identify it on the letter, it gives more confidence to the VO that the candidate is not pulling a fast one. You have to remember that it is our duty to prove to the VO that we are genuine applicants and provide him/her with appropriate paperwork that convinces him/her of our eligibility.

Why would not you re-word them according to NOC discription?

Can't hurt :) I plan on doing it. Although the response I got from HRSDC is for 2006 NOC, and I understand that applications received after May 2nd? will be assessed based on 2011 NOC. Should I bug them again or just use whatever they already sent me?

I received the response from HRDC as per 2006 list,,,, and even in the 2011 list None of my duties or Noc code has been changed... so I guess 2006 List is perfectly fine ... You can try sending an email to HRDC again Unless if there are any major changes your NOC Code...

Yea, I too received a response from HRSDC that notes 2006...but the 2011 description hasnt changed for my NOC, so I guess it would be good. I also included an explanation letter about my NOC match to shed some light, since my title wasnt on the list. Hopefully it will be enough to convince them... :)

My bigger concern with your post is that you state (as highlighted above) that you worked for 10 months/40 hrs per week. I hope when you submitted your application, you also had 2 months (min 30 hrs/week) more experience that was sent with your application. Because if you have applied with just 10 months experience, then my friend, NOC code is going to be the least of your worries.

Please, please, please say that you had minimum 12 months of experience when the application was sent along with the documentation supporting that.

The last assignment for 10 months, so he must have covered the rest in his current assignment... He also mentioned that he already sent his file a week ago.......

Thank you for your preoccupation Hopefulagain. In fact, I have 13 months of skilled work experience. I worked for 3 months as a translator in SK under implied status. Had to move out from the country due to a medical emergency that involved my mom's health. When you quit and leave Canada do you know if your experience working under implied status does not count anymore? I read a thread about that 2 days ago and am concerned about that. I have my new work permit with me that's dated 2 days after I left Canada. Now I'm thinking in writing an explanation letter once I receive my AOR telling the VO the reasons why I had to left Canada. I'm in touch with an immigration consultant and am waiting for his reply too. Let's see what happens!
