Wow thats nice. ..seems to me u r real guru...in refugee cases...sir can u tell me how to present at interview hearing in.front of judge or what to do...so judge can accept my case.give me some tips from.ur experience.i shall be very thankful to u.

Obviously every case turns on its own merits and the current human rights and security situation in the claimant's country of origin.

In short, the claimant's account must be consistent with the situation in his/her country of origin. You must go through the latest Country Packages and read the reports by Amnesty International, Human Rights Watch etc and pick out what is relevant to support the claimant's case but also what is against it.

Look at the country guidance case law - there may be cases similar to the circumstances described by the claimant.

The more evidence that a claimant can provide to corroborate his claim the better - newspaper articles, police reports, medical reports, court summons, political party membership cards, baptism certificates etc (depending on which of the five convention grounds the claim is based upon).

You must address the issue of internal relocation - can a claimant escape his persecutor by relocating to another part of his/her country of origin. This is particularly relevant where the persecutor is not the state but a certain warlord, family, criminal group, particular tribe/ethnic group.

Was state protection available to the claimant? Was the state unable or unwilling to protect the claimant. If the persecutor is the state itself or if there is a complete break down in law and order and government agencies in a state then state protection will not be available.

The claimant must be credible.

I should add that when answering questions a claimant should always listen carefully and keep answers simple and on the topic.

A lawyer or consultant should also never ask his client a question if he does not know what response will come out of his client's mouth!

Credibility and consistency will be enhanced by giving lots of detail about the incidents of persecution suffered and not giving conflicting or contradictory evidence. The account must be believable and in line with the humanitarian/security situation in the country of origin.

When you add in corroborative evidence such as the evidence contained in the national documentation packages and any other evidence a claimant is able to furnish to support their case (newspaper articles, medical reports, evidence of membership of banned political groups, police reports etc) then you can have a credible case.

For case law you can look on the Federal Court of Canada website or if you are a member of one of the bodies such as CAPIC you will receive case law bulletins

R u consultant? by the way...one question.how to get a quick date from irb...for legacy refugee case for immigration...any advice u like to give...?do u know about any back log for cases before dec 15 2012...how long it takes...???

It varies but i have seen most cases from 30 to 90 days approximately....received decesion letter...

By the way. ....what they said at end of ur hearing to u...?...and how long ur interview was? ?

acually I only pass the elgiblity interveiw , my hearing is till yet ... it will be in March ... im just asking you how long it take to recieve the decition after i attend my hearing.

Oh ok...if at end of ur interview....IRB member said congradulation to u...u r refugee...i.accept ur case...blab
..bla..bla..its mean u r accepted...u will receive ur decision letter in.one week...if irb member hold the decision it could take 30 to 90 days...some time chances r nope....
