How to stay working in Canada after Open work permit expires?

Hi,

I have an open work permit and I'm working full time in a company. My permit is going to expire this year and the company wants to keep me. Can I extend my permit? What are the possibilities? As I'm an employee doesn't make much sense publish new advertisements for the position I have then I understand LMIA is not the case.

I can't find information about it but I'm sure this is a common case.

Any advice is welcome!

Hi

The LMIA advertising requirements are in place because the company needs to show that they couldn't find a Canadian citizen/PR to do the job. If a qualified Canadian candidate applies for the job, then the company is obligated to hire them instead of you. This protects the Canadian labour market.

From the information you've provided, if your employer isn't able to obtain a positive LMIA, you will not qualify for a work permit extension.

Your employer needs to obtain an approved LMIA so that you can apply for a closed work permit. This includes advertising your job since this is a mandatory step in the LMIA process.

The LMIA process can take many months to complete. Make sure your employer starts early enough.

Thank you guys. I really disagree with how this LMIA process work, even more in cases like mine, but I know here is not the place to complain. Will keep looking for some way to solve this.
