Hi, i hope someone can help me! Im currently in Canada, i just recieved an email stating that my Permanent Residence application in complete and just waiting for landing appointment for my PR, the application includes my husband and my daughter, but somehow because of some issues from me and my husband he decided that he doesnt want to come to Canada anymore and thats fine with me, im just worried about my daughter because it might affect the sponsorship of my daughter aswell, is there anyway that i can withdraw or cancel my husband sponsorship and continue my the process of my daughter, because once i get the confirmation of my PR they will both automatically become PR. Can i get my daughter alone even if without his dad. My daughter is 12 years old by the way. And she really wants to be with me. I hope someone can help me..

Is your husband willing to provide authorization / consent for your daughter to move to Canada with you?

To be honest i didnt ask him yet. I will if i need that for me to get my daughter.
100% needed. I would start the conversation now. You can't remove your child from your country and bring her to Canada without his authorization.

As for the application, contact the visa office and request that his status be changed in the application to non-accompanying. It's not possible to entirely remove your husband from your application since you are still married. He needs to be part of your application.

As far as i know,
1) your husband can't land without you, as you are the main applicant you must be with him at time of landing. If you land alone its none of Canada's business. But as you said you are in Canada you must to your native country to bring your daughter. Once you land you can ask the authorities to cancel status of your husband.
2) In my opinion you don't need to have any authority letter from your husband to bring your daughter with you as you are still married in official records and daily hundreds of people travel with their children with out other parent.
3) Please consult some Lawyer, As said by Scylla you need an authority letter attested by local magistrate/notary that your husband has no objection If you take your daughter with you.

Thanks

Traveling with a kid without the other parent's consent is called kidnapping.

I believe their is a form for this. It’s a consent form stating that he is allowing to let the child be with you and that he understand that he wouldn’t see her once he signs it and that he will need proper papers if he wish to come to canada and see the child. I do not know if you have to use IMM 5604 in this case but this is what was being ask from me.
