How to prove implied status?

How can you prove that you've been on implied status for the past few months?

On February 19th I mailed in an application to extend a work permit which was about to expire a day later. CIC have yet to make a decision, but regardless of their verdict, what should I know about proving implied status to CIC so that I can use these past few months as additional experience under CEC.

CIC should have a record of this in their system, but inspite of that you can attach a copy of your WP ext application, any attorney letters if applicable and the payment receipt, canada post receipt..

Thanks yahoo7. :) That's also what I thought, but I didn't know whether I'd need to attach a cover letter or not.

Another quick question if you don't mind. I've heard that some work permits are not eligible for renewals so the applicant wouldn't get implied status if they try applying.

In my case, I held a PGWP which was about to expire, so I sent in an application for BOWP. Do I get implied status? Even if my application gets rejected? (I sure hope it doesn't; knock on the wood)

Hi whymee,

Switching from PGWO to BOWP, you will get implied status. I'm sure a lot of us here, including myself are in the same shoe as you are.
Why would you think your BOWP may get rejected? Are you qualified under BOPW?
Unless your CEC application gets process and results in refusal while waiting for your BOWP, your BOWP will not be rejected.

Thanks, and good luck to you too :)

And that's exactly what has happened. I even made a post about my rejection. I'm going to reapply after I receive GCMS notes.

oh, I see. I just read your post.
I am really sorry about your CEC application.
Have you filed your BOWP yet? Your BOWP will most likely get rejected as CIC has made a conclusion on your CEC application.
One of the fundamental criteria for BOWP is to have your CEC application in process with AOR.
Now that you no longer hold this criterion, I am not sure if you can keep working after your PGWP's expiry date.
If you do decide to keep working till you physically get refused on your BOWP, it may cause more issues down the road when processing your new CEC application.

Did you try calling CIC and ask?

Yeah, my BOWP has been in process for the past 2 months. I should get an answer soon.

I haven't called CIC call centre, because I find them useless from my past interactions with their reps. :/

You should call the CIC centre. I called them 2 days ago to get some update on my BOWP.
Make sure you ask an agent to open your file.
This is how I found out my application for BOWP was approved and it is in mail right now.

I may have misunderstood your situation.
I guess your PGWP had already been expired in Feb, correct?
Are you still working after your refusal on CEC application?
I am sure you can count in the days you have worked as implied up to the time you received your CEC refusal.
In my mind, I don't think you are even allowed to work as implied after the refusal of your CEC. Maybe seniors can help here.

You really should call CIC centre to be on a safe side.

This may help some people that are in a similar situation as me -

I just spent half an hour on phone with CIC, and after the representative double checked this with one of her colleagues, she told me that I will be under implied status until I receive a physical rejection letter by mail.

She also gave me 2 options for saying in Canada - get a company to apply for LMO, and then have me send in an application for worker status restoration for $350, or for $200 I can apply for status restoration as a visitor.

So there's that..

That is a good news that you can still work and you can count that towards your qualifying months for CEC.
getting a positive LMO may be hard, given the circumstances, but best of luck!
