How to know one has mis-represented?

Hello everyone,

I have applied for student visa 2 yrs back and got rejected with general reasons. However, I have submitted one of the document certified by different organization , I was not working with. The content of the letter was applicants(me & my spouse) will return back to the country of nationality after completion of the proposed studies and we(organization) will be ready to hire us as a staff. Will it be a cause of misrepresentation since I have mentioned about this on my FSW application this year.

In the rejection letter, they have not checked the box related to misrepresentation. As per general rule,minor misrepresentation may ban for two years for applying any scheme to Canada. If they find ,I have misrepresented ,this time,Will they ban me for applying for next two yrs. or will it be okay since It's been more than 2 yrs, from the time I applied for student visa?

In my understanding misrepresentation is misrepresentation and it will stay on your file. But consult a lawyer.

I think,I need to write my case little longer to make it clear for you guys to respond on my queries. I applied on May 2012 for student visa and got denied with reasons that VO was not convinced that I return back to my country after studies then I consulted this with my education consultancy and as per their feedback I requested my employer to write application on my behalf stating that I will return back after studies. Unfortunately, my employer ignored to write for me. Then, I got a letter from different organization who had written to VO on my behalf for the same that is I would return back after studies and serve our citizen through their organization. However, they have not written that I was an employee of that organization,just to convince VO that I do not stay in Canada longer than the time specified.

I again submitted my application on April,2012 along with the letter and again I was denied for the same reasons. They did not mention that I did misrepresentation in the refusal letter. Now,I am applying under FSW and need to mention that I was denied for student visa. If, they ask me to clarify about the letter submitted by me during the process of my student visa, how can I approach ....? Was that a serious issue which directly affect my FSW file?
