Hello Everyone,
I am new here and here's my story.
I am a Filipino Citizen and i was undocumented for 7 years in USA, i went home 6 months ago, i was never deported or committed a crime and paid all my taxes when i was there. Before i went home i met a guy online, we met 4 to 5 times before i went home, he is a Canadian Citizen and has a permanent residence in USA. I never thought our relationship will get serious when i went home, we continue our communication and he wants to marry me when he come visit me in the Philippines. He would like to go back to Canada for good and would like to sponsor me for a spousal visa.
My questions are:
1) Is there any negative impact for staying undocumented in USA when he sponsor me someday.
2) How can i get a Police clearance to USA if i was undocumented there and i am back in Manila. It says in the application that i need to get a police clearance to where i stayed for more than 6 months.
3)Or maybe i should not declare that i did stayed in USA?

From what my lawyer told me, the Canadian government does not care if you were undocumented in the U.S. This only reason they need to know if if you were in the U.S. while applying for P.R. in Canada. For example, if you entered the U.S. legally with a visa (i.e. travel visa, work visa, student visa) and then let it expire, you could apply for Canadian P.R. through the Canadian Consulate in Buffalo, New York. This only works if you are currently residing in the U.S. But since you left the U.S., you need to apply through your local visa office (probably Manila?).

Concerning the FBI clearance, you can get this report while in the Phillipines without any problem. You need to obtain the fingerprint card (see link), complete the application and send payment). They will mail it to you. It takes about 8-12 weeks to receive the report back. There is also a check list that you can use to assure that you are sending the appropriate items to get the report (see link below).

Be completely honest. Being undocumented will not hurt your case. Get your FBI fingerprints and leave the social security number section blank.
 
Hey guys- since her bf is in USA, doesn't he need to also prove that he will go back to Canada and live there?
 
She did say he wants to go back to Canada for good.

Just a point of correction: you can go through Buffalo only if you were originally admitted to the US for at least one year. If you entered on a tourist visa with the typical 6 month admission, you would not be able apply through Buffalo.
