How to Declare Earlier Termination of FSW Applic in Latest ITA dated April 2017

Dear Seniors,

There are two facts I want to share in my ITA application but I don’t know how since the questions relating them are confusing:

The facts are:

1)
I had filed for immigration in 2005 but later on it was returned back in May,2013 due to change of Immigration Policy with a termination letter mentioning following remarks:

“Job,Growth and Long Term Prosperity Act which became a law in 2012.Under this legislation, the FSW applications made before Feb 27,2008 were terminated by operation of law if a selection decision has not been made by the immigration officer before March 29,2012.

You have been affected by this provision and your application is one which has been terminated by Law.”


2)
I have traveled once to Canada on a visitor visa in 2016.

Queries:

-I am not sure under which question should I declare the above facts as both these questions look similar.
-Would TERMINATION (as mentioned in the letter) be treated as REFUSAL for answering the above questions.


There 2 questions are under the following heading : Statutory-> Personal History

Question 1
-Has XXXXXX been refused refugee status, or an immigrant or permanent resident visa (including a Certificat de sélection du Québec (CSQ) or application to the Provincial nominee Program) or visitor or temporary resident visa, to Canada or any other country?


Question 2
-Has XXXXXX ever been refused a visa or permit, denied entry or ordered to leave Canada or any other country?:

Termination doesn't necessarily mean rejection.

For question 1 and 2, answer is no unless you are rejected for any other country.

My initial thought was same as yours!But how and where do I mention about my Termination Letter .

I do not want to hide it and just want go make sure that it known, to avoid a case of misrepresentation.....But at the same time I dont want to go over board, and being too voluminous and declaring (if not required) and jeopardizing the whole case.

State it in ur letter of explanation (loe) , use bullet points format if u have many things to mention.

But the foremost answere is still remains unanswered that : WHAT IS THE DIFFERENCE BETWEEN THE TWO QUESTIONS.


-Is LOE a general covering letter mentioning all the docs being submitted or is it meant for mentioning such peculiar cases (a mine)
-Where is the Letter of Explanation uploaded or submitted.
-Is there any specific format.

Am slightly nervous on this fact of termination letter...are such cases common?

-Is LOE a general covering letter mentioning all the docs being submitted or is it meant for mentioning such peculiar cases (a mine) LOE is the medium through which you are communicating with your visa officer. Post ITA, at one of the stage when you upload documents in their specific upload place holder, you will have a place holder for LOE too to upload.

-Where is the Letter of Explanation uploaded or submitted.You will be asked to submit it Post ITA to clarify/help understood/explain anything about your application.

-Is there any specific format.
PDF document, your personal information e.g. name, passport no, addressing to visa officer, mentioning subject, paragraph(s) of explanation, scan copy(ies) of documents

Am slightly nervous on this fact of termination letter...are such cases common?
You have minor detail to let your visa officer know compare to some other applicants.

Thanks Can_Indian..You laid a lot of doubts to rest!....Just one more related query about this topic . Since these two questions are ambiguous in interpretation so just in case I answer yes (and give an explanation just below the question itself)...would it be okay to do so ? Basically I want to declare the fact and be done with it, rather than leave any loop holes for questions.

Also,kindly advise on Proof of funds: (if you want I can send is as a different post with relevant subject)

I am from India.I need to show around 12500 CAD for single person as Proof of Funds.I dont have it all in cash in savings account.
But ,yes ,if I add my Fixed Deposits in the bank then I can easily show this amount.So can you pls confirm if the amount in Fixed Deposits is considered as OK for showing liquid amount?

For cic purpose, you can show your Fixed Deposit as a POF, CIC doesn't require applicants to liquidate FD and transfer it to their bank accounts. You can leave it as it is. When you get a bank balance statement, make sure that bank manager mentions your FDs in your balance statement.
