How to cancel sponsorship undertaking of a sponsored PR spouse on domestic violence grounds?

Hello,

I am a Canadian PR since 2020. I got married in March 2023 and sponsored my spouse for PR to come and settle in Canada. She got her PR approved in December 2023 and came to Canada in January 2024. Couple of months of living together were the worst phase of my life being subjected to domestic abuse and mental harassment. I dropped her back in my home in country in April 2024 and came back to Canada and applied for divorce.

I understand that as part of PR spousal sponsorship, I am required to support my spouse for a period of 3 years from December 2023 to December 2026 no matter if I divorce her or not. My question is I feel cheated of being abused and having to loose my hard earned money on a system that was basically to protect sponsored victims from neglect and abuse (I guess they really did not give much thought about sponsored abusing the sponsorer).

My question is as follows:-

1. Is there a way to appeal to IRCC to request for exemption from undertaking in this scenario?
2. The actual spousal support seems to be enforced on provincial levels (for example for BC https://www2.gov.bc.ca/gov/content/life-events/divorce/family-justice/family-law/spousal-support). If we lived only in BC, can she claim only in BC or the undertaking applies throughout the country? Is the undertaking at the federal level or provincial level?
3. There seems to be lot of confusion on spousal support as part of spousal sponsorship undertaking for 3 years and spousal support as part of divorce. Which should I use in my case?

Nope. You made the choice to sponsor her. Why should other people be responsible if she seeks government assistance? You made your own bed so sleep in it!

2. Federal
3. Do you mean for your divorce case? If so, then that will focus on spousal support coming out of a divorce. The spousal sponsorship obligation cannot be changed or exempted.

She can claim in any of the provinces & territories. That amount owing is then offset typically to the Federal government who then uses the CRA to collect it .

So if there was a refund expected or benefit credit expected, those benefits would be applied to your outstanding amount

Any idea upto how much she can claim per month and on what basis is a reasonable range for a claim?

Depends on the province. Google social assistance and the name of the province to see approx monthly payout rates.

You have mentioned you dropped her in you home country. Do you think she will coming especially knowing that you are goin to divorce her? another thing you can do is ensure she stays in the country so that her time to be eligible for citizenship lapse.

How exactly is he going to prevent her from entering Canada?

You have mentioned you dropped her in you home country. Do you think she will coming especially knowing that you are goin to divorce her? another thing you can do is ensure she stays in the country so that her time to be eligible for citizenship lapse.
That gold digger *itch will come to Canada for first world PR status and for claiming spousal sponsorship for remaining 2 years. I don't think her PR can be revoked now.
