Hi,

I am new to this forum.I am a java developer by profession and willing to go and work out of Canada.Currently I am working out of Bangalore,India.

Can I apply for an open work permit?Also if I get the work permit,what are the chances of my spouse to get her work permit?She is also into software development.

Kindly inform me of the same if possible.

You don't qualify for an open work permit.

If you want to apply for a work permit to Canada, you will first need to find an employer in Canada who is willing to offer you a full time job. That employer will then need to obtain an approved LMIA. You will then qualify to apply for a closed work permit tied to that specific employer.

If your job is skilled (NOC A, B or 0) then your spouse will be able to apply for an open work permit based on your closed work permit.

1. No, you can't apply for an open work permit. You would have to find an employer in Canada, that is will to pay the $1000 for a Labour Market Impact Assessment. The employer would have to advertise the position in the job bank for 4 weeks and 2 other publications. Then s/he would have demonstrate to EDSC that there are no Canadian nor PRs qualified for the position. Whole process, if approved, for the LMIA, about 4 to 6 months.

Again, you need a job offer from a Canadian employer before you can apply for a work permit. The employer can hire you from your current location as long as they are able to obtain an approved LMIA. Obtaining an approved LMIA takes several months, costs the employer $1,000 in fees and forces them to prove that no Canadian could be hired for the role. For this reason it tends to be difficult to obtain a job as a foreign worker. But you can certainly try. Good luck.

Hey Arpan,

First forget about your Work Permit and think about how to get hired by Canadian Employer.

1. Go to Job Bank website which is hosted by the Canadian Government. Register there. Submit your Resume according to your skill.

2. If a Canadian employer thinks that you are the right person to his/her company, he/she should apply for Labor Market Impact Assessment (LMIA) and get approval. It usually takes 8 to 10 weeks (even more or less). employer should pay $1000 per application.

3. Once you get a Positive LMIA, It is were u need to think of Work Permit. Apply for work permit it would take again 8 to 10 weeks for visa approval.

if I have an approved LMIA and has a multiple TRV, can I go to Canada and process work permit there?
