How to apply for a yet-to-be-born child?

Hi everyone!

I am Vietnamese national who currently works in the US (I am not a US citizen, and don't have green card). I obtained a job offer in Ontario and a positive Labor Market Opinion, and am preparing an online application for work permit under “temporary foreign worker program” category.

Right now I am preparing my application, and am running into this issue which I don't know how to proceed: my wife and I are expecting our first baby in September. If we submit the application now, we have to choose the option “we don’t have children who will be moving with us” because the baby is not here yet and we don’t have birth certificate and other information about the baby. However, by the time we move to Canada, in December, our baby will in fact move with us and we might run into issues at the border. What we think we could do is that since the baby will be born in the US, the baby is a US citizen and can use her US passport to come to Canada with us. Then, once we are in Canada, we will submit paperwork for the baby. Is this the right way to do?

We certainly cannot submit the application after the baby is born, because my job starts in January.

I have contacted by email with the CIC New York and Los Angeles but I have not gotten a response (and of course they don't take phone inquiry).

Not really sure exactly WHAT you are asking.. You can't proactively add an unborn child as a dependant, so that's a non-issue.

So, you have already identified the only choices...
1) Defer the application, or
2) Bring the child to Canada as a visitor and hope that CBSA doesn't refuse entry.

Depending on what your LMO is for, you might find that the rules change anyway in the next few weeks/months...

We cannot defer the application because my job starts on Jan 1, 2015, and the baby will only arrive in September 2014. I guess 3 months would not be enough for the CIC New York or Los Angeles to process my application.

What I think I will do is that I will submit my application now, then when the baby arrives I'll add the baby into the application. Alternatively, I'll get the baby a US passport and hopefully the baby can travel to Canada as a tourist.

I would appreciate if anyone else has suggestions.
