I have a full appeal hearing coming up on July 17 2018 for sponsoring my wife from India. I asked the immigration lawyer how to respond to this question. She basically said u have to give an answer that shows u two will do anything to be together and not divorce. She suggested saying I'll move to India. I certainly don't want to move. I was just wondering what else I can say or other opinions.

Thanks

That really is the only viable answer. Of course you can say that you will reapply etc but the bottom line is that you will go to be with her, whatever that takes you to achieve.

If you dont say you'll move, expect to be refused. Genuine married couples get married because they want to be together, not for immigrating to one country only. If you refuse to move, then you'll probably divorce rather than have a long distance marriage, which is what they wont like

You should tell them what plans or types of jobs you would do there as well

The burden of proof on the applicants from some parts of the world when marrying a disabled Canadian citizen sponsor is rightly very high, especially if the sponsor appears to be vulnerable.

We have seen a number of similar cases in the past on the forum where it was clear that the whole thing was a scam.

I wish you well but be prepared for a long struggle. I've seen it suggested that the sponsor tell the applicant that they will come to live with them instead, and judge the applicant’s reaction to this. Please note that some of these cases have shown that the foreign spouse is prepared to invest years of their life in order to eventually get into Canada and then immediately dump the sponsor.

What did your gcms notes say were the reasons for refusal? You need to get your wife to prepare to address those reasons and why she's not marrying you due to your disability. How did you guys meet? Was it a quick courtship? Also is your wife open to having you live in her country? Or is she absolutely deadset on being in Canada? Does she have other relatives or family in Canada?

But why you said here earlier that you were able to sponsor? https://www.canadavisa.com/canada-immigration-discussion-board/threads/will-a-sponsor-be-eligible-to-sponsor-spouse-with-low-no-income.458763/#post-5537154

The truth seems to be that the OP is not willing to move to be with their spouse and is trying to find a way around saying that.

Then one has to ask how genuine the marriage is.

Had we needed an interview and if I were asked what we would do if my partner's application was refused I would have had no hesitation in saying (quite truthfully!) that I would stay in Australia with him or we would look to move to the UK where he's from. The goal is to be together, not to move to Canada. The reason we're moving there is that my family is there and we'd like to retire somewhere other than Australia.

Answer it honestly, we were asked that. Hands down we would have reapplied or appeal. When all fails i def would have moved there to be with him.

Say you would file an Application for Leave and Judicial Review before the Federal Court (if you intend on appealing a negative decision), for example.

That's awesome, how did you convince them your marriage was genuine despite the disability?
