Dear all,

I just graduated from my master's program at UBC and I just received a full-time job offer. I am holding a 3-year Post-Graduation Work Permit. My PGWP allows me to work anywhere in Canada and any employer in Canada.

I am filling up my Express Entry profile (after receiving the ITA) but the LMIA Assessment confuses me because I cannot state that my work permit is an open work permit. I would really appreciate it if you could advise me whether my answer to the following questions are correct:


1. Was a positive Labour Market Impact Assessment (LMIA) issued for the job offer in Canada?

My answer: No

2. Do you have a valid work permit for the current job in Canada?

My answer: Yes

3. Is your job offer from the employer named on the current work permit?

My answer: No

4. Have you been working full-time for the employer on their current work permit for at least one year? (Or for an equal amount of part time work?)

My answer: No

5. Four digit NOC code of current work permit

My answer: 2134 Chemical Engineers

6. Was a positive Labour Market Impact Assessment (LMIA) issued for the current work permit?

My answer: No


The confusing questions are No. 5 and 6.

- For No. 5, they force me to enter an NOC code. However, my work permit is an open work permit. So by entering an NOC code, I am basically saying that my work permit is NOT an open work permit?

- For No. 6, I am not sure because there are 4 options but I think my answer should be the first one.

> No - My work permit is exempt from an LMIA due to a Federal-Provincial agreement
> No - My work permit is exempt from an LMIA for other reasons and is employer-specific
 
That's because those questions are for applicant's claiming having a valid job offer 50/200, since you're working on a PGWP you do not have a valid job offer.

You have to answer "no" to the very first question in the intended work section, all other questions will disappear.

Does this mean that any PGWP-holder cannot have the 50 points even though he/she has a job offer?
 
There is a difference between having a job offer and having a valid job offer.

Open work permits do not qualify for those 50/200 points - you would have to get LMIA to be eligible.
